Town Board Meeting Minutes

August 7, 2018


  1. Call Town Board meeting to order.

Supervisor Fred Clark called the August 7, 2018 Town Board Meeting to order at 6:30 pm. 


  1. Roll Call.

Clerk Arnold called the roll the following Town Board Supervisors were present:  Phil Van Kampen, Arlen Christensen, Fred Clark, Steve Root and Clerk Denise Arnold.  Chairman Wayne Ace was absent.  Assessor Andy Blomstrom, absent.


  1. Approval of minutes from previous meeting.

Motion made by Christensen and seconded Root to approve the July 3rd, 2018 Town Board Meeting Minutes as presented.  Motion carried. 


  1. Financial Report and Acceptance.

Motion made by Root and seconded by Christensen to accept the July 2018 Financial Report as prepared by Deputy Clerk Treasurer, Jennifer Hanson.  Motion carried.  Clerk Arnold mentioned that the financial report was looking healthier due to receiving the loan proceeds from The Commissioner of Public Lands for the 2018 Summer Road Construction Project. 


  1. Public Comments.

Acting Chair Clark inquired if there were any Public Comments to bring before the Board? 

There being none the next item on the agenda was addressed. 


  1. Discussion and possible Approval of Recommendations from Plan Commission.
  2. Land Division and Rezone Request.  Petition #DCPREZ-2018-11322.  Parcel #0509-331-8050-0; 5571 Bellbrook Road, Brooklyn, WI  53521.  Owner and applicant is David and Lynn Stiklestad, 5571 Bellbrook Road, Brooklyn, WI  53521.

Supervisor Christensen shared that the Plan Commission recommended the Town Board approve the land division and rezone request for Dave and Lynn Stiklestad.  Van Kampen inquired about the driveway.  Mr. Stiklestad explained that there is an easement with a shared driveway agreement.  There will be no buildable site.  Motion made by Christensen and seconded by Van Kampen to approve Petition number DCPREZ-2018-11322 with no additional building sites for Parcel number 0509-331-8050-0 located at 5571 Bellbrook Road, Brooklyn, WI 53521. The owner and applicants are David and Lynn Stikestad.  Motion carried. 


  1. Commercial Rezone Request.  Petition #DCPREZ-2018-11315.  Parcel #0509-132-8676-0; 1088 Union Road, Oregon, WI  53575.  Owner is Benjamin Johnson, 1088 Union Road, Oregon, WI  53575.  Applicant is Jeff Groenier, W125 Amidon Road, Brooklyn, WI  53521.

Christensen reported that the Plan Commission approved and recommended the Town Board approve this petition.  The original survey was meets and bounds and that does not apply to the situation that is requested.  The new survey and rezone request will provide the opportunity for the owner to construct a new building for his business.  Motion made by Van Kampen and seconded by Christensen to approve Petition number DCOREZ-2018-11315 request for a Commercial Rezone on Parcel number 0509-132-8676-0 located at 1088 Union Road, Oregon, WI 53575.  The owner is Benjamin Johnson and the applicant is Jeff Groenier.  Motion carried. 


  1. Communication and Action of the Dane County Board – Bollig.

Dane County Board Supervisor Jerry Bollig reported that the County Board had only held one meeting in July.  The Village Board discussed Lincoln Road and agreed that $200,000 toward the Town of Oregon portion was reasonable.  The Village would like to coordinate the construction with the Town to insure a seamless paving job.  They were hoping to contract with Payne and Dolan and want an agreement with the Town to complete construction within the next two years.  Christensen inquired about a 45-mph sign that was on Lincoln and removed during the recent road construction that connected a Village Street to Lincoln Road.  Bollig said he would follow up with that.  Bollig also shared that he spoke with Pam Dunphy regarding road side mowing and it has been done. 


  1. Discussion and Possible Approval re:  Permit to construct within road right-of-way by TDS Metrocom. 

Sean Murray representative for TDS Metrocom requested a permit to construct within the road right-of-way.  Murray is the supervisor for permitting of the operation.  Van Kampen inquired what services would be provided?  Murray shared that internet, TV and phone service is being provided.  A permit was sent to the Clerk’s Office for Union Road.  Van Kampen asked if Forest Glen was included?  Murray provided a map displaying areas of service.  More could be expanded if interest in more services are requested.  TDS wants a 30% success rate in areas before expansion.  Van Kampen inquired about a franchise agreement.  Murray said there was a franchise agreement in place.  Clerk Arnold explained that there has not been a franchise agreement and advised that the permitting should not be approved without the security of an agreement.  Lead by Van Kampen the entire Board agreed that the permits should not be approved until a franchise agreement has been secured by Friday.  Murray assured the Board that he would see to it that the agreement be signed before Friday.  The Clerk also explained that a public utility can explore and start to create without a municipality approval due to changes in Wisconsin State Statutes.  Murray will be in contact with the Clerk. 


  1. Fire & EMS Report (Oregon/Van Kampen, Belleville/Clark, Brooklyn/O’Brien).

Van Kampen stated that there was nothing new to report.  Christensen inquired about an invoice received from the OAFED.  Van Kampen explained that $48,287 was for the 2018 budgeted operating expense installment, the $15,469 was for capital equipment purchases and $32,916 was the Town’s portion of the ambulance purchase.  Clerk Arnold inquired as to what equipment was purchased outside of the regular budget? Van Kampen referred to a report that listed the items.

Clark did not have anything to report for Belleville Fire/EMS.

Arnold shared that Ace reported that there was not a meeting in July for the Brooklyn Fire/EMS. 


  1. Park Committee Report and Action – Root.

Park Chairman Steve Root reported that the butterfly garden that was created is now on the National Registry for its existence. A plaque will be placed in the park for public awareness The Park Committee did not have any additional activity to report. 


  1. Anderson Farm Park Report – Root.

Root was unable to attend the last meeting.  Christensen was in attendance and reported that Eagle Scouts are constructing bat houses for Anderson Farm Park.  They are planting three more trees in the prairie area.  The farm lots were planned for 5 to 10 acres lots and decided that they might be too large, so they are going to make some 2 acres garden farm lots.  A water well is being planned at the park.  The dog park was not discussed.  Root shared he had direct contact with Darren Marsh from Dane County, arrangements will be made to work on taking two trees down on Union Road scheduled to be done late this fall. 


  1. Assessor’s Report and Recommendation – Blomstrom.

The Assessor was not in attendance. 


  1. Building Inspection Services Report – Arnold.

Clerk Arnold reported that there were 16 building applications submitted in the month of July 2018. 


  1. Update on Town Hall Painting Project – Christensen.  

Christensen shared that he talked to Gerhard Pehler regarding the painting that has been contracted.  Pehler is very busy and plans to do the work in September.  Public Works removed the overgrown bushes.  Christensen thought slow growing arbor vitaes would be a good replacement.  The Eagle Scout Sign also needs some work.  Root thought that would be an Eagle Scout project. 


  1. Constable’s Report – Maher.

Constable Kurt Maher contacted Clerk Arnold prior to the meeting to report he was unable to attend the meeting. 


  1. Plan Commission Report and Recommendation - Christensen.

Christensen reported on the two public hearings that were approved at tonight’s agenda.  Plan Commission Chairman Brian Duffin shared about a horse therapy operation Public Hearing they will be applying for a Conditional Use Permit (CUP) on Storytown Road.  Buildings will be constructed, and an extensive CUP located on 13.41 acres previously owned by Steve Ace.  Clerk Arnold said that phone calls have come in regarding their request to have unlimited animals.  They still need to provide a manure management plan.

  1. Public Works and TORC Report – Ace.

Chair Ace wanted to thank everyone that took the time to attend the Payne and Dolan outing.  Funds are needed and possibly planning in the budget for some trees that need to come down.  The storms that occurred in July cause limbs and trees to go down, in caring for that Ace noticed that even more should be taken care of.  Ace reported that new tires were put on the Chevy 1-ton truck.  New culverts were installed on Sun Valley Parkway, Lincoln Road and Ravenoaks Trail. 


  1. Discussion and possible Action re: Senior Center – Van Kampen.

Van Kampen did not have anything to report regarding the Senior Center there have been no meetings.  


  1. Board Communications/ Future Agenda Items.

Clerk Arnold reported that there was a request to change the date for the next Town Board Meeting.  Changing the date from September 4th to September 11.  Christensen could not make that date.  There is a joint municipality on September 12th.  After some discussion it was decided to remain with the September 4th, 2018 meeting date.


  1. Approval of payment vouchers – Arnold.

Motion made by Van Kampen and seconded by Christensen to approve the payment vouchers for July 2018 in the amount of $190,019.17.  Motion carried.


  1. Clerk’s Report and Loan Update – Arnold.

Clerk Arnold reported that the Belleville Bike Race and Run will be traveling through the Town of Oregon on August 11th.  The Election Public Test will be held on August 9th at 10:30 for viewing of the voting equipment being tested.  August 14th is the date of the Fall Partisan Election from 7:00 am to 8:00 pm.  August 15th at 7:00 pm is the Friends of Anderson Park Meeting.  August 21st at 6:30 is the Plan Commission Meeting.  On September 17th, at 6:30 pm is the next Town of Oregon Park Committee Meeting.


            Clerk Arnold shared a monthly loan balance report.  This report will be available monthly           to track the loan activity for the Town’s finances.  The Clerk was expressed concern with         

the recent additional expense from the OAFED and how that should be financed. The options are to pay the expense from fund balance or take a loan to allow the expense to be  added to the Local Levy Limit.  A report showing the history of the levy limit and potential future limits was shared with the Board.  The OAFED will be requesting approximately $100,000 more than in 2018 and Arnold wanted to inform the Board that this expense increase will happen in 2019 and supervisors should be made aware of this.  The Belleville Fire/EMS is also going be requesting that the Town of Oregon buy into the building expense.

  1. Adjournment.

Acting Chair Clark requested the Board revisit the September 2018 meeting date discussion before adjourning.  Clark felt that Supervisor Root should be included in the meeting.  It was decided the meeting would be changed to Tuesday, September 11th at 6:30 pm.**   Motion made by Root and seconded by Christensen to adjourn the August 7, 2018 Town Board Meeting at 7:40 pm.  Motion carried.

**The September Town Board Meeting will be held on Thursday, September 13th @ 6:30.  This change was made to include all Town Board Supervisors.
