August 21, 2017

 

  1. Call Town Board meeting to order.

 

Chairman Wayne Ace called the August 21, 2017 Town Board Meeting to order at 8:15 am. 

 

  1. Roll Call.

 

Clerk Denise Arnold called the roll the following Town Board Supervisors were present Phil Van Kampen, Arlen Christensen, Steve Root and Chairman Wayne Ace.  Absent:  Supervisor Fred Clark. 

 

  1. Discussion and possible Action re: Joel and Ruth McNair, 5792 Alpine Rd., requesting a letter from the town for driveway access of Lot 3; CSM 4259.

 

Supervisor Christensen said that the driveway is fine and it meets the requirements of the Town of Oregon.  The Plan Commission did not see any problem with this due to the driveway being grandfathered in.  Mr. McNair explained that he has a potential buyer and the buyer is requiring assurance that they would not have any expense to the common shared driveway and would have access from that driveway to their new home. The problem is that McNair claims the other property owners will not sign a joint driveway agreement.  Van Kampen noted that it may not help because the Town cannot not approve a driveway off a privately-owned easement.  The easement is not owned by the Town of Oregon.  McNair provided the verbiage that he wanted the Town to use in a letter for the buyer of his property.  There were concerns about the driveway being wide enough for the passage of emergency vehicles.  The existing driveway is wide enough for two vehicles to pass each other in an emergency situation.   Another concern was the Town Board writing a letter would not protect the buyer of the property because the other property owners could still refuse the new driveway.  The letter would aid Mr. McNair in selling the property however it may be misleading and not be in the best interest of the buyer.  The other property owners using and maintaining the common driveway were not able to be in attendance and therefore not represented.    After a lengthy deliberation, the board decided that the Town’s Attorney Lawrence Bechler should be contacted for legal assistance on this matter.  The Board agreed that a joint driveway permit is required. Clerk Arnold was instructed to forward the information accumulated on this subject to Attorney Bechler.  

 

  1. Discussion and possible Approval re: Roadway Access Agreement with Yahara Materials, Inc.

 

Supervisor Root had suggestions for this roadway access agreement that were emailed to the clerk however were not shared with the board.  Clerk Arnold will send of copy of those suggestions.  The item will be tabled for today.  The issue will be added to the September 5th, Town Board Meeting Agenda.

  1. Discussion and possible Approval re: Repair work on town garage.

 

Motion made by Van Kampen and seconded by Root to approve replacement of a service door with repairs on the Town Garage by Andy Meyer Masonry, LLC at a cost of $2,067.00.  Motion carried.  Christensen obtained three bids for painting the Town Garage and Salt Shed.  He also is working on a bid for covering the building with tin and insulating the building.  The Clerk was instructed to add this building maintenance to the September 2017 agenda. 

 

Clerk Arnold shared a copy of the Department of Revenue report that is released every August showing the changes statewide in equalized value.  The Town of Oregon had a -1.47% decrease which is considered acceptable.  Future agenda items include painting and building maintenance and the Yahara Roadway Access Agreement. 

 

  1. Adjournment.

Motion made by Van Kampen and seconded by Christensen to adjourn the August 21, 2017 Town Board Meeting at 9:25 am.  Motion carried.
