Town Board Meeting Minutes

September 6, 2016    

 

  1. Call Town Board meeting to order.

Town Board Chairman Wayne Ace called the September 6, 2016 Town Board Meeting to order at 6:30 pm. 

 

  1. Roll Call.

Clerk Denise Arnold called the roll.  The following Town Board Supervisors were present:  Phil Van Kampen, Arlen Christensen, Fred Clark, Tom Wiedenbeck and Chairman Wayne Ace.  Also in attendance:  Park Chairman Steve Root, Plan Commission Chairman Brian Duffin, Absent:  Assessor Andy Blomstrom and Constable Gary Wackett. 

 

  1. Approval of minutes from previous meeting.

Motion made by Van Kampen and seconded by Christensen to approve the August 2, 2016 Town Board Meeting Minutes.  Motion carried.  Motion made by Clark and seconded by Wiedenbeck to approve the August 4, 2016 Joint Town Board and Park Committee Meeting Minutes as presented.  Motion carried.  Motion made by Van Kampen and seconded by Clark to approve the August 23 Joint Town Board and Plan Commission Meeting with corrections at the bottom of page 2 in the Arlen Christensen portion (insert the word learn) and at the top of page 3 under Brian Duffin’s comment A-3, should be changed to RH.  Motion carried. 

 

  1. Financial Report and Acceptance.

Motion made by Van Kampen and seconded by Clark to accept the financial reports for July and August 2016 as prepared by Deputy Clerk/Treasurer Jennifer Hanson.  Motion carried. 

 

  1. Public Comments.

Bill Buglass with Payne & Dolan discussed holding an open house at the new pit site in Brooklyn tentatively on October 11, 2016 at 5:30 pm.  A tour of the active pit which is now 80% complete will begin at 6:00 for all Town Officials.

 

Tim Fox, residing at 5669 Bellbrook Rd. Brooklyn, WI 53521 wanted to share with the Town Board that he did not want to separate from Dane County Zoning.  He spoke in opposition of Wisconsin Act 178 to opt out of Dane County Zoning.  Fox expressed that County zoning is good. Chair Ace explained that a vote was taken at a Joint Town Board and Plan Commission Meeting held on August 23, 2016 and it was decided that the Town of Oregon would remain with Dane County Zoning and continue working cooperatively.  Fox wanted to know how many vacant lots are in the Town of Oregon.  That number is unknown.  Fox also wanted the speed of vehicles addressed on Bellbrook Road.  Too many deer and dogs are killed there and it seems like 55 mph means 65 mph on Bellbrook. 

 

Dane County Deputy Sheriff Leslie Fox addressed the recent fatal hit and run accident on Lincoln Rd between a truck and bicyclist.  Fox explained that bicyclists have the same rights as motor vehicles on roadways.  They may legally ride two abreast unless impeding traffic.  If bicyclists are not obeying the law it is difficult to catch them as they do not have visible license plates.  Fox had a neighborhood meeting in Ravenoaks, there was open communication regarding crime prevention.  This was the best turnout that Fox has experienced for neighborhood meetings.  The neighborhood agreed to watch each other’s property.  Fox left information with the Clerk’s Office regarding bicycle safety.

A letter from Trevor Passmore residing at 671 Rimpoche Lane in Oregon that was directed to the Town Board was shared.  Mr. Passmore is concerned about the safety of Lincoln Road for bicyclists.  Chairman Ace suggested all Town Board Supervisors read this. 

 

  1. Discussion and possible Action re: Driveway Variance Request Josh and Toni Wills, south of 999 Glenway Rd.

John McDonough residing at 210 Glenway Rd, Brooklyn, WI 53521 requested a driveway variance for Josh and Toni Wills.  The new driveway will be located at 999 Glenway. Supervisor Christensen recommended an 18” oval culvert.  There is not any way of avoiding the driveways being so close there is only 250’ between the driveways.  Motion made by Christensen and seconded by Clark to approve a driveway variance for 999 Glenway Road, owner Josh and Toni Wills.  Mr. McDonough purchased a 30’ culvert and the Board amended the variance to approve that size of culvert.  Motion carried. 

 

  1. Communication and Action of the Dane County Board – Bollig.

Dane County Supervisor Jerry Bollig shared that Dane County has started the Public Hearing process for their budget.  The public is welcome at 6:00 pm.  The budget will be approved in November/December. 

 

  1. Discussion and possible Approval re: Brooklyn Fire EMS contract.

Mark O’Brien presented the Brooklyn Fire and EMS Protection District contract final draft and wanted the Town Board to approve it.  Ace inquired if all municipalities      must approve the contract.  O’Brien stated that 4/5th vote is required.  The Fire Board approved it by 4/5th.  Van Kampen inquired about a clause regarding what happens when a municipality pulls out.  O’Brien said that their debt must be satisfied.  Van Kampen wanted to know what happens if a municipality does not pay their full amount rather a lesser amount.  Van Kampen suggested that the Attorney be involved should this happen.  Wiedenbeck referred to page 11 of the agreement where all five participating municipalities must agree and sign.  Van Kampen sited discrepancies and felt that an attorney would need to review it. Van Kampen also explained about substitute commissions should not be allowed.  To avoid an issue a substitute can attend a meeting however not vote. 

 

  1. Fire & EMS Report (Oregon/Van Kampen, Belleville/Clark, Brooklyn/Wiedenbeck).

O’Brien said that the tanker bid has been approved.  It will take a year to get it.  Van Kampen reported that OAFED Fire Chief Mlnarik resigned and has accepted a position at Bellevue, WI.  Upon his resignation Mlnarik suggested a candidate for an acting Chief, Glenn Linzmeier the former Chief of Blooming Grove.  The Fire Commission has hired Linzmeier for about five months.  The Commission will start the hiring process right away.  Clark reported that Belleville is running smooth. 

 

  1. Park Committee Report and Action – Root.

Park Chairman Steve Root reported that the soft surface trail is changing to a hard surface trail and is approximately 70% complete.  Root thanked Bill Buglass and Payne and Dolan for donating the gravel for the project.  The Park Committee would like the board to approve “in concept” a trail from Sheil, Town Park, Glenway, Locust Grove to Anderson Park for a direct trail.  Van Kampen wanted to know if the neighbors are in favor of this.  Christensen felt that running on Glenway is a problem.  Root suggested that Christensen bring it up at a Park Committee Meeting.  Ace had concerns with Glenway Road also.  Root said there is grant money available.  Chairman Ace added that despite Root leaving the Town Board still needs to work with the Park Committee.  Clark agrees with what has been discussed and voiced additional concerns about Glenway.  Neighbors need to be informed.  Ace felt Dane County was in favor of this.  Plan Commission Chair Brian Duffin

felt there should be a Public Hearing.  Root also mentioned an article in the Madison Magazine that suggested that a route be established on Tipperary Road and this suggestion has increased the bicycle traffic on that road.  Chairman Root was disheartened by negative comments at the last Town Board Meeting.  If you have issues Root suggested to please take it up the Park Committee to give everyone a chance to discuss any issues.  Root also said he will stay on as Chair until the bike path projects are completed and Ace will fill in when Chair Root is gone.  Chair Ace apologized if anything at the prior board meeting was misunderstood or inappropriate regarding the Park Committee. 

 

  1. Assessor’s Report and Recommendation – Blomstrom.

Assessor Blomstrom was not in attendance, no report was submitted prior to the meeting.

 

  1. Building Inspection Services Report – Arnold.

Clerk Arnold reported that there were seven building permit applications in the month of August 2016. 

 

  1. Constable’s Report – Wackett.

Constable Gary Wackett submitted a report for the Town Board Supervisors to review.  Wackett logged 365 miles and 16.5 hours in August 2016.  He made 19 park checks, 2 persons were advised of park hours.  There was one assist with Dane County Sheriff’s Department with an intoxicated driver on Glenway Rd and Bellbrook Rd.  One animal complaint at 381 Union Rd and one check persons at Tyler St and Johnson Ave.   

 

  1. Anderson Farm Park Report.

Supervisor Christensen reported on Anderson Farm Park’s Annual Meeting coming up on September 21st from 6:00-8:00 with a potluck and everyone is invited to that event.  Ace stated that it is a good meeting to attend.  There is a bonfire scheduled for November 2016.

 

  1. Plan Commission Report and Recommendation - Wiedenbeck.

Wiedenbeck inquired if a petitioner for a conservation subdivision should be responsible for the mapping amendment expenses.  Duffin replied that the petitioner would be responsible for the expense each request for this type of subdivision would be handled separately. 

 

  1. Discussion and possible Action re: Letter from Van Kampen to support and remain with Dane County Zoning from Wisconsin Act 178.

Item tabled until the October 2016 meeting. 

 

  1. Public Works and TORC Report – Ace.

Ace reported that the road work is completed and looks the best it has been in years.  Public Works has been busy with roadside mowing, tending to washouts and tree trimming. 

 

  1. Discussion and possible Action re: TORC employee.

A notice will be posted at the Senior Center for the available positions at the TORC due to the retirement of Ken West and Sam Ace.

 

  1. Discussion and possible Action re: Update on Town’s budget.

The preliminary 2017 OAFED Budget request amount is $148,520 which is down slightly from 2016.

  1. Discussion and possible Action re: Senior Center – Van Kampen.

Van Kampen reported that the Senior Center has not had any meetings, the next scheduled meeting is a Joint Municipality Meeting on September 28th at 6:30 pm.    

 

  1. Discussion and possible Action re: Oregon Senior Center funding.

Item tabled to the October 2016 Town Board Meeting. 

 

  1. Board Communications/ Future Agenda Items.

The October 4th,  2016 Town Board Agenda should include the Senior Center, Approval of correspondence to Dane County Zoning prepared by Van Kampen, replacement of retiring TORC employees Ken West and Sam Ace, approval of Brooklyn Fire/EMS District Contract and the purchase of radio systems for public works.  Chair Ace mentioned that we have an offer on the V-plow for $5,000 from the Town of Beloit.  Clark mentioned that his Dad has a dumpster appropriate to dispose of plastic silage bags.  Any area farmer is welcome to dispose of bags in that dumpster. 

 

  1. Approval of payment vouchers – Arnold.

Motion made by Clark and seconded by Van Kampen to approve the August payment vouchers in the amount of $283,118.42.  Motion carried. 

 

  1. Clerk’s Report – Arnold.

Clerk Arnold shared that she is leaving for vacation tomorrow for three days and is scheduled to be off the following Thursday and Friday.  Arnold shared that when everything is balanced at the end of September she will begin the budget process.  The Presidential Election ballots will arrive this Friday, September 16, 2016 and open absentee voting will begin on Monday, September 19, 2016.  Supervisor Clark requested that the purchase of radios be placed on the October 4, 2016 agenda. 

 

  1. Adjournment.

Motion made by Clark and seconded by Christensen to adjourn the September 6, 2016 Town Board Meeting at 8:00 pm.  Motion carried.
