Town Board Meeting Minutes

June 14, 2016

 

  1. Call Town Board meeting to order.

Chairman Wayne Ace called the June 14, 2016 Town Board Meeting to order at 6:30 pm. 

 

  1. Roll Call.

Clerk Denise Arnold called the roll the following were present:  Chairman Wayne Ace, Supervisors Phil Van Kampen, Arlen Christensen, Fred Clark and Tom Wiedenbeck. 

 

  1. Approval of minutes from previous meeting.

Motion made by Van Kampen and seconded by Wiedenbeck to approve the May 3, 2016 Town Board Meeting Minutes as presented.  Motion carried. 

 

  1. Financial Report and Acceptance.

Motion made by Van Kampen and seconded by Christensen to accept the Financial Report for May 2016 as prepared by Deputy Clerk/Treasurer Jennifer Hanson as presented.  Motion carried.  Clerk Arnold shared that the financials were in balance between the Treasurer’s and the Clerk’s records for the month of May 2016. 

 

  1. Public Comments.

Clerk Arnold shared email correspondence with a resident regarding the property located at 6163 Oak Hollow Drive, Oregon, WI 53575.  The resident registered a complaint regarding the bright lights located at that address.  Arnold sent a letter to the owner Mr. Scott Faust explaining that a complaint about his lights had been filed with the Clerk’s Office.  Mr. Faust responded that he has security issues and felt the lighting was necessary and had no intentions of changing it. The complainant may attend the next meeting.  Clerk Arnold wanted to inform the Board Supervisors of the situation. 

 

Bill Buglass of Payne & Dolan introduced Spencer Johnson that helps manage quarries.  Johnson is soliciting bids for working on the Wingra property for shouldering and preparation for the new operation.  The bid process should be done in the next couple of weeks and be operating in July/August.  The crushing may start before the end of the season.  Buglass thanked the Town of Oregon for their continuous support and cooperation during this process.

 

  1. Discussion and possible Action re: 2016 Road Work/Bids.

Clerk Arnold explained the bid comparison sheets that were provided and a total expense page as well.  Ace asked the bidders that were present to identify themselves and share which company they work with.  Cory Braund from Scott Construction, Sam Bilhorn from Payne & Dolan and George Polnow from Fahrner Sealers were all present.  Motion made by Ace and seconded by Van Kampen to award the pulverize and repave work to Payne & Dolan.  The following roads will be competed:  Kennedy Park Road for $22,338, Woodvale Drive for $32,731, Forest Glen for 28,798,

Trusler Circle $10,406, for a total bid of $94,273 to be completed in late July or first part August 2016.  Motion carried.  Ace inquired if Payne & Dolan would support that the Town replace 6 driveway culverts and Payne & Dolan repave those driveways after the repair work was completed.  Motion carries.  There will be additional expense if the Town goes six to eight feet into the driveway.  Bilhorn explained that Payne and Dolan would go two to three feet into the driveway at no additional charge.   Chair Ace discouraged the asphaltic wedge paving procedure despite that bids were requested for consideration.  There was a decision to table the wedging project because it is an expensive short term fix for roads.  Supervisor Van Kampen questioned Arba Road being included in the seal coat bid as there is only one resident on the road.  Ace said that is a legal road and should be maintained.   Motion made by Ace and seconded by Van Kampen to award the seal coat bid to Farhner Construction on the following roads Hillcrest Lane for $23,772, Glenway Road for $23,266, Echo Valley Road for $6,474, Sugar Hill Road for $4,034, Arba Road for $5,113, Rome Corners Road for $15,273 for a total of $77,932.  Motion carried. Motion made by Ace and seconded by Christensen to award the 2016 crack sealing bid to Crack Filling Service to crack fill the following roads Heather Lane for $500., Hillcrest Lane for $4,000, Glenway Road for $3,000, Echo Valley Road for $2,000, Sugar Hill Drive for $1,200. Arba Rd $2,000 for a total cost of $12,700.  Motion carried.  This work will be done before the sealcoating.  The decision to decline the wedging results in an excess of budget road construction funds of $66,285.  The Board decided that they would meet before the Plan Commission Meeting on Tuesday June 21, 2016 to possibly approve more seal coating.  

 

  1. Discussion and possible Approval of Recommendations from Plan Commission:
    1. Land Division and Rezone Request. Petition # DCPREZ-2016-10993; Parcel #0509-044-8020-0; 5; west of 5553 Netherwood Road.  The request is for creating one residential lot.  The property would be rezoned from A-1Ex to A-2(4).  Petitioner and Owner is Rita Kluever, 5848 Madsen Circle, Oregon, WI  53575.  A request for a driveway variance.

Motion made by Van Kampen and seconded by Clark to approve the land division and rezone petition # DCPREZ-2016-10993 for owner Rita Kluever with an agreed upon driveway variance.  Motion carried.  Supervisor Christensen will work with Mrs. Kluever to establish the proper driveway placement. A $1,000 Town Impact Fee will be required at the time that the Clerk would sign the CSM. 

 

  1. Land Division and Rezone Request.  Petition # DCPREZ-2016-10994; Parcel # 0509-141-8500-1; 425’ east of 5093 Lincoln Road.  The request is to creating one residential lot.  The property would be rezoned from A-3 to RH-1.  Petitioner and Owner is Tom Buglass, 5075 Lincoln Road, Oregon, WI  53575.

Motion made by Van Kampen seconded by Clark to approve land division and rezone request #DCPREZ-2016-10994 for owner Tom Buglass to create one residential lot. The property would be rezoned from A-3 to RH-1.  Motion carried.  A $1,000 Town Impact Fee is required.  The driveway is already approved.  Driveway agreement is complete.

  1. Discussion and possible Approval of Renewal Alcohol Beverage License Application JDB Golf, LLC (Foxboro Golf Club), 1020 County Road MM, Oregon, WI.

Motion made by Van Kampen and seconded by Clark to approve the renewal of the Alcohol Beverage License for JDB Golf, LLC (Foxboro Golf Club).  Motion carried. 

 

  1. Discussion and possible Approval for Renewal of Operator’s Licenses at JDB Golf, LLC (Foxboro Golf Club): Justin Stone, Nathan P. Malek, Brook T Schmitt.

Motion made by Van Kampen and seconded by Clark to approve the renewal of Operator’s Licenses at JDB Golf, LLC (Foxboro Golf Club) for Justin Stone, Nathan P. Malek and Brooke T. Schmitt.  Motion carried.  Background checks were performed by Constable Gary Wackett on the applicants. 

 

  1. Discussion and possible Action re: Purchasing projector and laptop.

Motion made by Clark and seconded by Van Kampen to approve a projector, laptop and screen to provide visuals for Plan Commission Meetings, Board Meetings and election training not to exceed $2,500.00.  Motion carried. 

 

  1. Discussion and possible Action re: Payment of flooring at town hall.

Motion made by Van Kampen and seconded by Clark to approve payment for the Town Hall flooring that had been installed by Walgenmeyer’s Carpet & Tile in the amount of $9,836.00.  Motion carried.  There is a sufficient supply of additional tiles stored in the Town Hall.

 

  1. Discussion and possible Approval re: Reappointment of Arlan Kay and Brian Duffin to the plan commission for a term of three (3) year until 6/2019.

Motion made by Van Kampen and seconded by Christensen for the reappoint of Arlan Kay and Brian Duffin for a three year term on the Plan Commission.  Motion carried

 

  1. Discussion and Action re: Property Compliant at 5349 Netherwood Rd.  

There was discussion regarding a complaint on the property located at 5349 Netherwood Rd. The property owner Ted Rowley has made a slight effort to clean up and he is in the process of constructing a privacy fence.  The Board decided to not take further action unless there were more complaints. 

                                                                                                                                                                                                                                                                                           

  1. Communication and Action of the Dane County Board – Bollig.

Dane County Supervisor Jerry Bollig was not in attendance at the meeting. 

 

  1. Fire & EMS Report (Oregon/Van Kampen, Belleville/Clark, Brooklyn/Wiedenbeck).

Van Kampen reported that the OAFED paid for the ambulance in full to receive a 1% savings.  The ambulance will be delivered around September.  The Town’s share will be approximately $38,750.  Clark reported that Belleville Fire/EMS was holding their meeting this evening.  Clerk Arnold reported that Mark O’Brien explained that each municipality needs to approve the Brooklyn/Fire EMS joint agreement.  There is some confusion regarding if there needs to be 100% approval.

  1. Park Committee Report and Action – Root.

Park Chair Steve Root met with George Pulnow from Farhner.  Fahrner will re-sealcoat the parking lot in the Town Park along with paint stripping.  The Trails will not seal because it is in a shaded area however they will clean and crack fill the trail, all at no cost.  The Park Committee has tabled the disc golf permanently because the area is not large enough to support it.  Root reported that the trails need to be brush cut, take out stumps and widen the trails.  Motion made by Van Kampen and seconded by Christensen to approve the renting of a stump grinding attachment for the bobcat at $140 per day.  Motion carried.  Root recommends that a part time employee take care of the park mowing to decrease the expense to the Park funds.  Motion made Christensen and seconded by Van Kampen to hire a part time employee at a rate of $15.00 per hour to mow the parks. 

 

  1. Assessor’s Report and Recommendation – Blomstrom.

The Clerk’s office is work on balancing with Dane County and the Department of Revenue on the Town’s Assessment roll. There are some minor complications being worked out with the Assessor. 

 

  1. Discussion and possible Action re: 2016 Building Inspection Fee Schedule.

The Clerk’s Office will be meeting with Mike Post from Safebuilt on Wednesday June 29th, to discuss making the Town’s Building Inspection Fee Schedule more in line with other municipalities.  Hopefully we will be prepared to approve a new fee schedule at the July Town Board Meeting.

 

  1. Building Inspection Services Report – Arnold.

There were nine building permits applied for in the month of May 2016.  The service is going okay.  Van Kampen suggested office hours and it may need to be considered. 

 

  1. Constable’s Report – Wackett.

Constable Wackett submitted a report prior to the meeting.  In the month of May he logged 170 miles and 9.5 hours.  There were 14 park checks, 3 people were warned of park hours.  Wackett also cleaned up broken glass from the Town Park, parking lot. 

 

  1. Anderson Farm Park Report.

Clerk Arnold shared the agenda from the Anderson Park Friend’s meeting along with an email of events scheduled in the future.  Christensen reported that at the last cook out they experienced issues with the parking lot being too small.  The next meeting will be held on June 22, at 6:00 pm.

 

  1. Plan Commission Report and Recommendation - Wiedenbeck.

Wiedenbeck reported that Attorney Mark Hazelbaker attended the last meeting to share information on Act 178 re: allowing municipalities to opt out of Dane County Zoning.  Next month representatives from Dane County will explain Act 178 from their viewpoint.

  1. Public Works and TORC Report – Ace.

Ace reported that roadside mowing is behind because they have had tractor issues.  The shelter for the TORC Employees has been constructed by Oregon School Students. 

 

  1. Discussion and possible Action re: Dead deer pickup on town roads.

Clerk Arnold informed the Supervisors that the DNR will no longer pick up roadside dead deer.  The DNR suggest to drag the animal into tall grass to allow it to decompose naturally.  The Clerk’s Office is still trying to locate a service to remove the deer when it happens in a sub division or area where there is not tall grass.  The Town is not allowed to bury the deer. 

 

  1. Discussion and possible Action re: Potential Impacts of the state’s 2016-17 Budget Bill.

Clerk Arnold did not have any new items to inform the Board. 

 

  1. Discussion and possible Action re: Senior Center – Van Kampen.

Supervisor Van Kampen reported that the Village of Brooklyn has decided to pull out of financing the Oregon Senior Center.  This will cause about a $20,000 budget deficit.  If the Senior Center Budget for 2017 would be the same as the prior year the Town would be responsible for approximately $4,000 more.  This does not include any increase however the Senior Center could see a 7% or even maybe more in the future.  This increase would also occur every year it is not a temporary situation.  It is unknown if Brooklyn would donate any funds outside of the agreement.

 

  1. Board Communications/ Future Agenda Items.

Arnold shared that the Dane County Towns Association created a Working Committee on Town Zoning.  Attorney Tony Varda Chairman of the Town of Berry has agreed to Chair the new group.  It is suggested that any Town considering opting out of Dane County Zoning should have a representative from their municipality participate.  The Town Board was not currently interested in assigning a representative.  By October 1, 2016 the Town must declare that they may opt out but not required complete the process.  Brooklyn Fire/EMS contract and the financing of the Senior Center should be on the agenda for July 2016.  Supervisor Wiedenbeck requested a closed session at the end of the July meeting to discuss personnel. 

 

  1. Approval of payment vouchers – Arnold.

Motion made by Clark and seconded by Ace to approve the payment vouchers for the month of May 2016 in the amount of $209,765.88.  Motion carried. 

 

  1. Clerk’s Report – Arnold.

Clerk Arnold shared that the Milkman Triathlon will pass thru the Town of Oregon on June 19, 2016.  There had been a rental complaint regarding the conditions of a home that was rented, the location is 202 Tipperary Rd. Brooklyn.  The renter has reported that the dwelling is unsafe for living.  The Clerk’s office referred the renter to tenant resources and have not heard anything more from them.  Arnold learned that any fees incurred by hiring an inspection service for the situation

could be passed on to the property owner as a special assessment on their tax bill.  Since the initial contact by the renter there had not been other calls regarding the issue so there is no need to act on anything at this time.  The Board instructed the Clerk to involve the Board if anything more comes up that needs to be addressed. 

 

  1. Adjournment.

Motion made by Clark and seconded by Wiedenbeck to adjourn the June 14, 2016 Town Board Meeting.  Motion carried.
