Town Board Meeting Minutes
July 5, 2016
Chairman Wayne Ace called the Town of Oregon Board Meeting to order at 6:30 pm.
Clerk Denise Arnold called roll, the following Town Board Supervisors were present, Phil Van Kampen, Arlen Christensen, Fred Clark, Tom Wiedenbeck and Chairman Wayne Ace. Absent: Assessor Andy Blomstrom and Constable Gary Wackett.
Motion made by Clark and seconded by Wiedenbeck to approve the Town Board Meeting Minutes from June 14, 2016 as presented. Motion carried. Motion made by Wiedenbeck and seconded by Christensen to approve the Special Town Board Meeting Minutes from June 21, 2016 as presented. Motion carried.
Motion made by Van Kampen and seconded by Clark to accept the financial report as prepared by Deputy Clerk/Treasurer as prepared. Motion carried.
Chair Ace inquired if there was anyone in attendance that wanted to share any public comments or items not already listed on the agenda. There being none the next item on the agenda was addressed.
a. Land Rezone Request. Petition # DCPREZ-2016-11017; Parcel # 0509-164-6258-3; 5571 Ralph Road. The request is to rezone to allow reduce setback for proposed addition. The property would be rezoned from R-1 to R-3. Petitioner and Owner is Eric Dammen, 5571 Ralph Road, Oregon, WI 53575.
Motion made by Wiedenbeck and seconded by Christensen to approve Petition #DCPREZ-2016-1107; Parcel #0509-164-6258-3 located at 5571 Ralph Road, Oregon, WI 53575. The request is to rezone to allow a reduced setback for a proposed house addition. The property will be rezoned from R-1 to R-3. The Petitioner and Owners are Shane and Erin Dammen. Motion carried.
Motion made by Van Kampen and seconded by Christensen to instruct the Clerk to complete the necessary annexation questionnaire documents required for the Village annexation from the Town of Oregon land owned by the Lutheran Church-Missouri Synod (1.794 acres). The land will be used by the Village of Oregon for the purpose establishing a well for future expansion. Motion carried.

Dane County Board Supervisor Jerry Bollig shared that Dane County Circuit Judge John Markson ordered Dane County to pay $10,757.50 to the Dane County Towns Association because the County sued DCTA without legal authorization. This is all in regard to the Dane County Zoning opt out program that is now available. Bollig shared that the rezones for Rita Kluever and Tom Buglass both passed at the County level. The Dane County Fair will occur in two weeks.
Clerk Arnold shared an email exchange from Joanne Van Norman of the Brooklyn Fire/EMS regarding the agreement which is not yet prepared to be voted on. This item was tabled. Ace did share that progress is being made.
Supervisor Van Kampen reported that Captain Robin Powers resigned from the OAFED. A Captain position would require more time in the department than any of the staff have served. A Lieutenant position was created and this allowed a promotion internally. Negotiations are starting as the Union Contract is going to expire. The new ambulance should be delivered in September/October and Town’s share of the expense will be due at that time. Supervisor Clark did not have any new information regarding the Belleville Fire/EMS because their last meeting was on the same evening as our June Town Board Meeting. There was nothing additional to share from the Brooklyn Fire/EMS.
Park Chairman Steve Root requested that the excavation needed on the bike path project should be done by the Town Public Works Department as that is how the bids were calculated. This will also save park funds. Root shared that he is retiring as Park Chair in August 2016 however he would consider serving into September to allow sufficient time to appoint a new Chairperson. Root has served on the Park Committee since 1981. He requested that an advertisement be placed in the Oregon Observer as none of the current park committee members want the position. Root will amend the August Agenda to add items that they are planning on recommending to the Board. The Board expressed their appreciation to Root for the work that he has done. An advertisement will be placed in the paper July 20, 2016 and August 10 is the proposed date for interviews that will be conducted by the Park Committee. A joint Town Board and Park Committee Meeting will be held on Thursday August 4, 2016 at 6:30 pm. The Town will be present and will be taking action on the recommendations proposed by the Park Committee.
In the absence of Assessor Blomstrom; Clerk Arnold shared that the Statement of Assessment is balanced with Dane County and has been filed with the Department of Revenue.
After some discussion a motion was made by Van Kampen and seconded by Clark to approve the new Building Inspection Fee Schedule to be used with Safebuilt. Motion carried. Arnold is negotiating to change the percentage for the fee split from 90/10 to 80/20 in the new Safebuilt contract which will include a clause to terminate the contract with an acceptable notice. (90 days).

Clerk Arnold reported that nine new building permits were applied for in the month of June 2016.
Constable Gary Wackett submitted a June 2016 Constable’s Report that was shared with the board.
Supervisor Christensen attended the Dane County Park Commission Meeting and reported that Dane County is very pleased with the work that the friends of Anderson Farm Park volunteers have accomplished. The meeting was held in the Town Hall then they dismissed for a Tour of the Anderson Farm Park to view the progress and discuss the future plans. Root shared that he talked with Darren Marsh, Dane County Park Commissioner; he said that Dane County was enthused and supportive of the bike path that the Town of Oregon Park Committee recommended. Root said that Dane County appreciates the cooperative effort from the Town of Oregon.
Supervisor Wiedenbeck reported that they recommended the approval for Shane and Erin Dammen for a rezone to allow for their proposed house addition. There was discussion regarding a conservation subdivision that Susan Krebsbach is exploring. Considerable research would still need to be done. Plan Commission Chair Brian Duffin shared that perhaps Krebsbach could pursue a different venue rather than the conservation subdivision such as the Prairie Enthusiasts. Duffin thought that different studies should be conducted prior to a public hearing such as water and traffic studies. He was concerned as to who would pay for those expenses. Clerk Arnold explained that when a submittal comes before the Clerk’s Office there is a form that the petitioner must sign and agree to that the petitioner would be financially responsible for any expenses incurred in the process of their project. Deputy Clerk Hanson has repeatedly encouraged Krebsbach to explore the cost of the roads to establish the conservation subdivision. Duffin also questioned Jerry Bollig from the Village of Oregon as to a potential athletic facility built near or in the Town of Oregon. Bollig shared that there are not any formal plans. Union Road cannot support that kind of traffic for a large sports facility at the Anderson Farm Park. There were appearances by Brian Standing and Roger Lane from Dane County Zoning discussing WI Act 178 and other zoning rules. The next Plan Commission Meeting will be held on Tuesday July 19, 2016.
Public works have been doing road patching and clearing signs on Town roads. The shed shelter is complete for the TORC. Clark and Ace will be working on securing the structure.
Clerk Arnold did not have any items to share regarding the Town’s budget.
Supervisor Van Kampen reported that there was no new items for the Oregon Senior Center.

Van Kampen shared that with Village of Brooklyn pulling out of the Senior Center funding the Town of Oregon portion would increase by $3,500 to $4,000 annually to make the center whole. The other option is to request that the Senior Center cut their budget. Clerk Arnold shared a history of payments made to the center from 2003-2016. The Town will contribute $53,200 in 2016. The Board decided to wait to make a decision at budget time when the numbers were more firm.
The Board did not request any future agenda items for the August meeting. Chair Ace brought up the possibility to seal coat Netherwood Road. Van Kampen questioned the need, Christensen thought that it would be helpful. The Board decided to wait. Ace also requested having a joint Plan Commission and Town Board Meeting on Tuesday, August 23, 2016 at 6:30 pm to discuss the possibility of opting out of Dane County Zoning.
Motion made by Van Kampen and seconded by Clark to approve the June 2016 vouchers in the amount of $248,453.70. Motion carried.
Clerk Arnold shared that the Boys and Girls Club of Dane County will host a bicycle ride that will go thru the Town of Oregon on July 16, 2016.
Motion made by Van Kampen and seconded by Clark to adjourn into closed session per WI. Stat. § 19.85 (1)© to discuss personnel. Motion carried.
