Town Board Meeting Minutes

December 1, 2015



1.      Call Town Board Meeting to order.

Supervisor Phil Van Kampen called the December 1, 2015 Town Board Meeting to order at 6:30 pm.


2.      Roll call.

Clerk Denise Arnold called the roll the following were present:  Supervisors Phil Van Kampen, Steve Root, Fred Clark, Tom Wiedenbeck and Constable, Gary Wackett.  Assessor Andy Blomstrom arrived at 7:00 pm.  Chairman Wayne Ace was absent due to illness. 


3.      Reading and approval of minutes from previous meeting.

Motion made by Root and seconded by Clark to approve the meeting minutes from the 2016 Town of Oregon Budget Hearing held on November 11, 2015.  Motion carried.  Motion made by Wiedenbeck and seconded by Root to approve the Town Board Meeting Minutes from November 3, 2015 as presented.  Motion carried.


4.      Financial Report and acceptance.

The Union Bank & Trust Company certificate of deposit #11497 in the amount of $264,663.21 will mature on December 19, 2015.  The Board instructed the Treasurer to transfer the funds to a more available account rather than another certificate of deposit.  A different layout of the Park portion of the financial report was available, the board requested this be provided each month.  Motion made by Root and seconded by Clark to accept the Town of Oregon November 2015 Financial Report as prepared by Deputy Clerk/Treasurer Jennifer Hanson.  Motion carried.


5.      Public Comments.

Bill Buglass of Payne and Dolan informed the Town Board that testing with a sonic drill has been performed on the land adjoining the Klahn Pit in Brooklyn.  The test results proved to be worthy of expansion for more aggregate product.  The sonic drill went down 70 to 80 feet and took a tube sample that was vibrated into clear bags for inspection.  Payne and Dolan will be submitting a conditional use permit (CUP) in 2016 with the Town and Dane County.  Buglass was realistic that there may be some opposition to the expansion but assured the Town Board that Payne and Dolan would be contacting residents in the affected area in a timely manner when the application is submitted to the Town. 



  1. Eagle Scout Presentation.

There was not an Eagle Scout Presentation in the month of December 2015.


  1. Discussion and possible approval regarding:  Resolution number 03-2015; Town Fee Schedule.

This item was tabled because the full fee schedule was not available at the time of the meeting.  Motion made by Root and seconded by Clark to table this item.  Motion carried.

  1. Discussion and possible approval regarding:  Ordinance number 84; Town Cemetery Ordinance. 

This agenda item was tabled due to the volume of information included in this ordinance.  This Ordinance was provided by the Wisconsin Towns Association and will not require legal review.  Motion made by Wiedenbeck and seconded by Root to table this item.  Motion carried. 


  1. Discussion and possible approval regarding:  Update on changes to the Town’s Mobile Homes Ordinance. 

Supervisor Wiedenbeck explained that he created the Mobile Home Ordinance, with research and assistance from Dane County Zoning.  The Clerk mentioned that this Ordinance will need review from a legal source.  Van Kampen inquired if anything in the Ordinance was contrary to Dane County’s Ordinance.  The Town is somewhat unique because there is not actually a mobile home park.  Root mentioned that the Ordinance does not address the slide in truck campers.  Wiedenbeck will amend the Ordinance to include the slide in truck camper and all board members will review this before it is forwarded to legal counsel. 


  1. Discussion and possible action regarding:  Outside vehicles at 5264 County Highway CC. 

The Clerk shared copies of the emails regarding the property currently owned by Brian Tarkenton which is located at 5264 County Highway CC in the Town of Oregon.  The property currently has over 40 cars most are owned by TJ Auto Sales located in the Village of Oregon.  Mr. Tarkenton thought that the property was zoned commercial and did not think this was a problem.  He would like to rezone the property to accommodate his business.  Under current zoning the cars should be contained in a building.  Tarkenton was starting the process of removing some for scrap metal.  Van Kampen said the immediate issue is that there are too many vehicles and they need to be removed if they do not run or not registered.  Tarkenton is also cooperating with Pat Klinkner of Dane County Zoning.  The Clerk shared that restrictions could still be placed in the CUP to limit hours of operation and number of vehicles.  The Village may also have the opportunity to weigh in on this issue due to extra territorial zoning.  Van Kampen encouraged Mr. Tarkenton to contact the Village of Oregon as well. 


  1. Discussion and possible action regarding:  The Anderson Farm Park progress.

Root commented that many people are using the trails at the park.


  1. Communication and action of the Dane County Board – Bollig.

Dane County Supervisor Jerry Bollig shared that the Dane County portion of the 2015 property tax bill will be increasing.  Bollig gave the example that a $225,000 dwelling will increase approximately $100.  The Village of Oregon will continue to plow the Oregon Youth Center parking lot.  There is a movement from some Towns to abolish the use of Dane County Zoning and conduct their own zoning.  The Cross Plains area has been pushing hard to accomplish this.  Bollig share this option will be coming up and the Town of Oregon will need make a decision what to do in the future.

  1. Fire & EMS Report (Oregon/Van Kampen, Belleville/Clark, and Brooklyn/Wiedenbeck).

Van Kampen shared the OAFED financials are very good year to date and will be in budget for 2015.  There is one more municipality left to approve the ambulance purchase.  Clark did not have any new information to share from the Belleville Fire/EMS.  Wiedenbeck reported that Brooklyn did not meet; the next meeting will be December 16, 2015.  


  1. Appointment of Election Inspectors:  Mike Burkhalter, Becki Clark, Beth Cox, Kathy Dauck, Beth Garvoille, Lori Goodspeed, Maya Hann, Jim Huntoon, Esther Huntoon, Ruth Jeschke, Bob Johnson, Chris Johnson, Maria Kluever, Betty Kluever, Sue Moreland, Linda Orloff, Laura Richardson, Wanda Schrank, Julie Seaborg, Sandy Shackelford, Brad Smith, Liz Van Kampen, Tom Wiedenbeck, Barb Wiedenbeck, Bev Nehls, Kathy Wolf and Gunnard Swanson. 

Motion made by Clark and seconded by Van Kampen to approve the appointment of the named Election Inspectors all of which have attended training with the Town of Oregon Clerk Arnold and Deputy Clerk Hanson.  Motion carried. 


  1. Discussion and possible action regarding:  Flooring & painting bids for Town Hall. 

Motion made by Wiedenbeck and seconded by Root to accept the bid by Phoenix Painting and Decorating, Inc. with a deduction adjustment for the repair of the hole in the drywall from the door knob because Supervisor Wiedenbeck has already fixed this.  The current price is $1,760.00.  Motion carried.  The work should be completed in January before the February 2016 primary election.  The flooring bids varied in quality and pricing making it difficult to decide which one was the best choice.  The Board narrowed the bids down to two, requesting that the Clerk contact them before the January 2016 meeting to provide products to evaluate and how they are going to handle the difficult flooring crack procedure.  The Clerk will contact Walgenmeyer’s Carpet and Tile and Floor 360 for samples to be available at the next meeting.


  1. Discussion and possible action regarding:  Financing Oregon Area Fire & EMS ambulance. 

Van Kampen requested to table this agenda item until there was a full board present.  Clerk Arnold inquired about the legality of lending to the other municipalities in the OAFED.  Attorney Hazelbaker stated no in email correspondence, however there may be some circumstances that would be allowable.  Van Kampen will check with the Attorney for the OAFED before the next meeting. 


  1. Park Committee Report and action – Root. 

Root shared that the Park Committee took a courtesy vote of approval for the purchase of the truck that the Town Board approved to purchase at the November 2015 meeting.  The Park Committee was accepting of the financing using park funds.    


  1. Assessor’s Report and recommendation – Blomstrom. 

Assessor Blomstrom reported that he will be looking at the details of all sales and sending personal property notices.

  1. Building Inspection Service Report – Arnold.

Reports were provided from Independent Inspections/Safe Built.  Clerk Arnold shared that the Town will show a loss for building permit fees in 2015 due to the duplication of services with the Village (Mike Kleisch) and Independent Inspections/Safe Built. 


  1. Constable’s Report – Wackett.

Constable Wackett shared that he had one assist with Dane County Sheriff’s Department, kids in Town Park, one dog off leash in the Town Park, follow up in junk car complaint for 5264 Hwy. CC, three park checks in the Town Park.  Root inquired about checking Sheil Drive, some residents noticed vehicles parking there.  Wackett will watch for that. 


  1. Plan Commission Report and recommendation – Wiedenbeck. 

Supervisor Wiedenbeck reported that the Plan Commission discussed the 5264 Hwy CC vehicle issue with a request to remove vehicles within 30 days.  The fee schedule had no additional changes.  The Plan Commission also discussed the changes in the new mobile home ordinance that was written and proposed by Wiedenbeck.  The Plan Commission will not meet in the month of December 2015. 


  1. Public Works and TORC Report – Ace. 

Clerk Arnold shared that the TORC is now closed on Wednesdays.  Public Works is having difficult time obtaining sand this season.  Public Works employee Abel Schultz will be working on that.  The Town is currently $13,649 under budget on salt and sand. 


  1. Discussion and possible action regarding:   Sale of equipment.

Motion made by Van Kampen seconded by Clark to sell or dispose of the following pieces of equipment:  Grader, V-Plow and Truck.  Motion carried.  Motion made by Wiedenbeck and seconded by Root to accept the Truck bid from Town of Brooklyn for $13,000.  Motion carried. 


  1. Discussion and possible action regarding:  Town Hall Improvements.

Duplication of agenda item not needed. 


  1. Discussion and possible action regarding:   Potential Impacts of the State’s 2015-16 Budget Bill. 

Clerk Arnold shared the progress of the levy limits and milrate calculation.  All taxing jurisdictions increased their levy to the Town.  Both the First Dollar Credit and Lottery Credits have gone down slightly. 


  1. Discussion and possible action regarding:  Oregon Senior Center – Van Kampen.

Van Kampen reported that the Oregon Senior Center has not had any meetings.


  1. Discussion and possible action regarding:  Review of Town Ordinances.

There are not any Ordinances ready for approval at the time of the December 1, 2015 meeting.

  1. Board Communications/Future Agenda Items. 

The January 5, 2016 Town Board Meeting Agenda should include the following:

  • Discussion possible approval re:  Resolution #03-2015; Town Fee Schedule.
  • Discussion possible approval re:  Ordinance #84; Town Cemetery Ordinance.
  • Discussion possible action re:  Update on changes to the Town’s mobile homes ordinance
  • Town Hall flooring.
  • OAFED Ambulance Financing


  1. Set Date of January 2016 Caucus.

The 2016 Caucus date will be Saturday, January 16, 2016 with a snow date of January 23, 2016. 


  1. Approval of payment vouchers – Arnold.

Motion made by Root and seconded by Clark to approve the November 2015 payment vouchers in the amount of $46,376.36.  Motion carried. 


  1. Clerk’s Report – Arnold.

Clerk Arnold reported that a training session was held for our staff of election inspectors.  More training will be conducted at the public test in February. 


  1. Adjournment.

Motion made by Root and seconded by Wiedenbeck to adjourn the December 1, 2015 Town Board Meeting at 8:05 pm.  Motion carried.
