Town Board Meeting Minutes
October 18, 2011
Chair Darryl Weber called the October 18, 2011 Special Town Board Meeting to order at 6:00 pm with the following Town Board Supervisors present Phil Van Kampen, Jerry Jensen, Chris Johnson, Wayne Ace, Treasurer Rhonda Christensen LaFlash, Park Chair Steve Root, Clerk Denise Arnold and resident Christopher Brent. Absent: Assessor Andy Blomstrom.
The Clerk presented a spread sheet with the financial information regarding an assessor’s tax error on parcel number 0509-064-9015-0 and 0509-064-8671-0 owned by Christopher Brent and Jacquelyn Mitchard. Brent and Mitchard currently reside in the Town at 6160 Sun Valley Parkway, Oregon WI 53575. The Clerk also provided information collected from the Town’s Attorney and the Dane County Treasurer. Mr. Brent had submitted letters to Clerk Arnold requesting a refund of overpayment of taxes from 2004 thru 2010. A second letter was submitted requesting the 2011 valuation on the parcels be corrected to avoid further errors.
Motion was made by Chair Weber and seconded by Supervisor Van Kampen to instruct Clerk Arnold to amend the 2011 Town of Oregon Assessment Roll and submit an amended Town of Oregon Statement of Assessment to Dane County and the Wisconsin Department of Revenue to correct the Assessor error in valuation for the parcels listed:
Parcel number 0509-064-9015-0 currently $138,000 Residential to $23,000 Undeveloped Ag.
Parcel number 0509-064-8671-0 currently $251,700 Residential to $76,900 Undeveloped Ag.
After reviewing the information provided, considerable discussion and interaction with the property owner Mr. Brent the Town Board Supervisors decided not to refund any illegally charged taxes. Wisconsin State Statute 74.37 specifically states that a claim for an excessive assessment must meet all of the conditions of said Statute. Following these conditions is important for the Town to collect the rescinded funds from the various taxing jurisdictions.
Clerk Arnold researched if the penalty and interest charged by the County could be waived due to the assessor’s error. The County shared there is not a Wisconsin State Statute to provide for such a reduction. The entire Town Board expressed remorse for the situation. In the future the Clerk will assist Mr. Brent in the objection process. There are objection documents that will need to be submitted at the appropriate time for Board of Review 2012. Clerk Arnold also requested that Mr. Brent provide a forwarding address and contact information.
Motion made by Jensen and seconded by Johnson to adjourn the October 18th Special Town Board Meeting. Motion carried.
After a short recess the Town Board proceeded with the 2012 Budget Work Session.
Motion made by Van Kampen and seconded by Johnson to adjourn into closed session pursuant to Wisconsin State Statute § 19.85 (1)(C) to discuss personnel. The following Town Board Supervisors were present in a roll call Chair-Darryl Weber, Wayne Ace, Chris Johnson, Jerry Jensen and Phil Van Kampen. Motion carried.
Motion made by Jensen and seconded by Johnson to return into open board session.
No action was necessary. Motion carried.
Motion made by Van Kampen and seconded by Ace to adjourn the meeting. Motion carried.
