Board Meeting Minutes
January 3, 2006

     The regular monthly meeting for the Town Board of the Town of Oregon was held Tuesday, January 3, 2006. Chairperson Gerald Jensen called the meeting to order at 7:00 pm with Supervisors Darryl Weber, Pen Beasley, Phil VanKampen, Wayne Ace and Clerk, Denise Arnold present.

     MMS/Ace-VanKampen to approve the minutes as read from the December 6, 2005 board meeting. Motion carried.

     MMS/Weber-VanKampen to approve the treasurer’s report with total disbursements of $129,099.10. Motion carried.

     Town resident Myra Hann reported on the Storytown Cemetery. Mrs. Hann shared a brief history of the cemetery timeline and her volunteer work revising the current Burial Rights Contract. The clerk went on record thanking Myra for her efforts. The Hanns’ framed the original cemetery plot map, with a hand-crafted picture frame which now hangs in the town hall. Chairperson Jensen suggested that the board members and the clerk review the document, make recommendations and necessary changes to approve the Burial Rights Contract at the next board meeting.

     Board Supervisor Darryl Weber presented a recommendation to approve the conditional use permit for Payne and Dolan for the Charles Stearns property. Supervisor Ace questioned the pattern of traffic from the quarry site on Union Road. Bill Buglass representative from Payne and Dolan explained that the information was covered in item number nineteen. The affected town road would be Union Road from Locust Grove southerly to CTH A. There is a bond maintained of $20,000.00 as security for damage done to Union Road attributable to its use for hauling and other quarry operations. Chairperson Jensen inquired about the level of charge used in blasting, would the same guidelines be used as those at the Anderson Quarry? Mr. Buglass assured the board that all blasting shall be conducted in strict accordance with the State of Wisconsin regulations by licensed blasters, same as the Anderson Quarry. The State allows a peak particle velocity of 0.5 inches per second and Payne and Dolan will not exceed 0.2 inches per second. MMS/Weber-VanKampen to approve Conditional Use Permit #1997 in section 24 parcel #0509-242-8001-0 and parcel#0509-242-8070-0 currently zoned A-2 and A-3 rezone to A-2 CUP and A-3 CUP. The property is owned by Charles Stearns. The petitioner is Payne and Dolan. Request for a conditional use permit (CUP) to allow nonmetallic mineral extraction, i.e. limestone quarry. Motion carried.

     MMS/Jenson-Weber to have a separate agreement with Payne and Dolan for the compensation of road usage and wear. A conditional fee upon approval of the CUP #1997 contract to be drawn up where as Payne and Dolan will compensate the Town of Oregon at a rate of $0.05 per ton of product hauled out of the Stearns Quarry, to be paid annually. This may be a compensation of use of materials rather than a financial compensation at the discretion of the Town Board. Motion carried.

     MMS/Jensen-Weber to approve the zoning amendment petition #9385, section 34; parcel #0509-344-8700-0 & 0509-344-9000-9 currently zoned RH-1 and A-1 EX. Property is owned by Craig and Rachel Schley, request to relocate their building site. Motion carried. A driveway permit with a possible variance would be needed.

     The board discussed the Building Variance request for Douglas Nelson and Janice Kowalczyk. Chairperson Jensen expressed that an agreement should be provided regarding the stipulation that if one or both of the parcels directly involved is sold that the quonset building would be removed. The parcel rezone had been withdrawn at the county level and could not be approved. Chairperson Jensen said he would contact Mr. Nelson as he was not in attendance at the meeting.

     Patrolmen Ron Outhouse presented the bids that had been submitted for the purchase of a new truck. MMS/Ace-Weber to accept the bid from Capital City International, Inc. 2006 model #7400 for $66,017.27 with a trade in allowance of $24,000.00 for the 1996 International Truck currently owned. The final price will be $42,017.27. Motion carried.

     MMS/Weber-VanKampen for approval of cost share for the patching trailer with the Town of Rutland and the Town of Dunkirk for total cost of $11,535.00, one third of the cost $3,845. Motion carried.

     Supervisor Weber reported that the Comprehensive Plan is still a work in progress and the next work session will be held Monday January 9, 2006 at 7:00.

     Supervisor VanKampen reported on the Oregon Fire/EMS District progress. The Village has sent a letter stating that they plan to withdraw from the district effective 2007, however Supervisor VanKampen shared that negotiations will continue.

     Chairperson of the Park Committee, Steve Root reported that the park committee did not meet in December and the next meeting would be held January 30th. Patrolmen Ron Outhouse inquired about the posts that were proposed to be installed at the town park. It was suggested that Ron check into the cost of a 6’ post, buried 3’ deep, 5’ apart and 12” x 12” around.

     Supervisor Beasley reported that there were no new developments for the cable committee.

     Chairperson Jensen mentioned that the Giles Gobel land split was approved at the Dane County level, the other two petitions were postphoned.

     Supervisor Van Kampen had no new information from the Towns/Village Metro Bus Study Committee.

     The Clerk reported that Grota Appraisals had signed out a group if assessors files for review, no report back on how that was going. The Town had been awarded a grant of $1,500.00 for the use of creating a railing for the safe entrance of a handicap individual into the town hall. Local contractor Jeff Owens will complete the work as soon as the weather permits before the first of April 2006. Three eight yard single stream low profile containers were delivered to the TORC. After the first week it was determined that one more container would be needed. The newspaper and aluminum cans are still being sorted.

     The Town of Oregon has been issued a VISA credit card for the use of the clerk’s office, the patrolmen and one for Jerry Jensen. This was done to provide a paper trail of purchases and avoid reimbursements to indiviuals A Board of Review training session will be held in Steven’s Point in mid March or April the clerk would like to attend this training and two board supervisors were also interested. The clerk reported that a claim has been opened for the playground equipment that had been vandalized at the Town Park.
