  1. Open Public Hearing:

Chairman Brian Duffin called the public hearing to order at 6:35 p.m. on Tuesday, September 18, 2018.

  1. Land Rezone Request.  Petition # DCPREZ-2018-11344.  Parcel #0509-172-8000-9 and 0509-172-8500-4; 5995 County Highway D, Oregon, WI  53575.  The request is to rezone 18.272 acres from A-1Ex to C-2 and 3.6 acres from LC-1 to C-2.  No new building sites will be created.  Greenscapes would like to conduct retail sales of plants, flowers, trees, mulch, stone, landscape block, dirt and sod that would be grown on site.  Owner is Greenscapes RE LLC, 2960 Triverton Pike Dr., Fitchburg, WI  53711.  Applicant is Jake Fleming, 2960 Triverton Pike Dr., Fitchburg, WI  53711.

Jake Fleming appeared for Greenscapes, a full-service landscaping/contracting business located at 4633 Highway 138, Oregon, WI  53575.  They have been operating at this lcoation for six (6) years and outgrown this site.  They purchased the property at 5995 County Highway D to move their operation and expand their business to include retail sales, storage of materials and growing of trees, bushes and plants.  Greenscapes is requesting to rezone 21 acres to C-2 zoning to accommodate the expanded uses.

 

The audience asked the following questions. 

  1. How much traffic volume given the 100 parking stalls on the layout?
  2. The layout is a rough draft.  Traffic may increase a little more than what was previous, but don’t expect a steady flow of traffic.   
  3. What are the hours of operation? 
  4. The hours will be 7-4 Monday through Saturday.  The landscaping/contracting business is done off-site and winter hours depends on the need for plowing. 
  5.  Where would the sod be grown?  How much water would be taken out of the ground? 
  6.  Sod is a possibility, but not the focus of their business.  No sure on water.
  7.  What steps will be taken to prevent crazy worms?
  8.  They will take any necessary precautions to prevent insects or invasive species. 

 

Fleming explained the difference between Greenscapes and Winterland Nursery is that they own and operate a landscaping/snowplowing business.  The trucks and equipment for the landscaping business will originate from this location, but the crews would travel off-site to work. 

 

Fleming said that currently three (3) acres of the property is zoned LC-1.  They are requesting to rezone into C-2 to meet the future needs of the business.  Duffin explained that the town co-zones with Dane County.  The county is uncomfortable with C-2 zoning because the town land use plan and map doesn’t support C-2 zoning.  The other zoning options are A-B or C-1with conditional uses.  Winterland has A-B zoning.  Fleming feels A-B zoning would work for the nursery, but not the landscaping/contracting business including outdoor storage of materials, vehicles and equipment.

 

There are twenty-five (25) to thirty (30) employees in the summer and up to fifty-five (55) employees in the winter.  All employees would originate at this location.  There was discussion about the number of parking spaces needed.  There would be about twenty (20) vehicles and trailers.  They plan to install a sign, but no additional lighting.  Duffin stated that the county enforces the sign requirements.  A. Christensen said they will be required to stay back one hundred (100) feet from the corner of County Highway D and Storytown Road to not block the vision of traffic.

 

It was discussed that the hours of operation for the retail nursery to be 7:00 a.m. to 6:00 p.m. and the landscaping/contracting business from 6:30 a.m. to 5:00 p.m.  There was discussion of A-B zoning, increased traffic and outdoor parking of equipment.  Fleming said there no plans for anyone to live on the property. 

 

The town will limit the zoning to only the uses needed by applicant and will not allow other uses in the zoning district.  There was discussion about split zoning the property.  There was concern about the zoning of the house for use as an office building.  The hours of operation for the landscaping/contracting business would vary to handle snowplowing.  Kay would like a solid presentation and specific layout of the business operation.  The plan commission postponed the petition until next month.

 

  1. Land Division and Rezone.  Petition # DCPREZ-2018-11353.  Parcel #’s 0509-033-9810-5, 0509-034-9000-4, 0509-034-9000-4, 0509-034-9070-0 and 0509-034-9270-8; 5375 Netherwood Rd., Oregon, WI  53575.  The request is to rezone 3.04 acres from A-2 to RH-1, 6.70 acres from A-2 to RH-2, 16.02 acres from A-2(8) to CO-1 and 44.72 acres from A-2 and CO-1.    The request is to separate the buildings from farmland and donate remaining land for park/conservancy.  Owner and Applicant is Patrick Hermsen, 5375 Netherwood Rd., Oregon, WI  53575 

 

Patrick Hermsen, 5375 Netherwood Rd., appeared to rezone his land to separate the two homes from the rest of the property.  The remainder of the property would be zoned into a conservancy to be donated to the Village of Oregon.  The Village of Oregon will not take possession of the property until Pat or his wife passes away.  The agreement with the village is still being arranged.  The property will remain in conservancy for eternity and overseen by a nature conservancy.

  1. Call Plan Commission meeting to order.

Chairman Duffin called the Plan Commission to order immediately following the public hearing. 

 

  1. Roll Call.

Present:  Sharon Christensen, Arlan Kay, Supervisor Arlen Christensen, Dave Hagemann, Andy Blomstrom, Tim Yanacheck, and Chairman Brian Duffin

Also Present: Town Board Supervisor Phil Van Kampen, Deputy Clerk Jennifer Hanson and several members of the public

 

  1. Discussion and possible Recommendation to the Town Board.
  2. Land Rezone Request.  Petition # DCPREZ-2018-11344.  Parcel #0509-172-8000-9 and 0509-172-8500-4; 5995 County Highway D, Oregon, WI  53575. 

Petition was tabled until next month.

Hagemann clarified that the land could be deeded to the village at any time.  Motion made by A. Christensen and seconded by Yanacheck to approve Petition # DCPREZ-2018-11353.  Motion carried 7-0.   

 

  1. Approval of minutes.

Motion made by A. Christensen and seconded by Hagemann to approve the Plan Commission Meeting Minutes from August 21, 2018.  Motion carried 7-0.

 

  1. Public Comments.

Phil Van Kampen explained the town and the village reached an agreement regarding the maintenance of Lincoln Road.  The Village of Oregon would take over maintenance of Lincoln Road from Union Road to just past Bergamont.  The village would give the town $200,000 to repave from just past Bergamont to Fish Hatchery Road.  All work will be completed at the same time within two (2) years.  The village is also giving a few loads of salt. 

 

  1. Discussion and possible Recommendation to the Town Board re: Draft Zoning Map for Dane County Comprehensive Revision.

Dane County will be here on Monday, September 24th to give a presentation on the zoning revision to town residents.  The meeting will be run by the county.

 

  1. Communications.

Duffin discussed the town’s land use map that was updated in 2010 and whether the town will want to add back in the commercial zoning. 

 

  1. Adjournment.

Motion made by S. Christensen and seconded by Hagemann at 8:35 pm.  Motion carried.
