Plan Commission Meeting Minutes

  1. Open Public Hearing:

Chairman Brian Duffin called the public hearing to order on Tuesday, July 17, 2018 at 6:35 pm. 

  1. Land Division and Rezone Request.  Petition #DCPREZ-2018-11322.  Parcel #0509-331-8050-0; 5571 Bellbrook Road, Brooklyn, WI  53521.  The request is to separate the existing residence from the farmland.  The existing residence with 8.3 acres will be rezoned from A-1 Ex to A-2 (8).  No new building sites will be created.  Owner and applicant is David and Lynn Stiklestad, 5571 Bellbrook Road, Brooklyn, WI  53521.

David and Lynn Stiklestand, 5571 Bellbrook Road, Brooklyn, WI 53521 appeared to request a separation of the existing residence from the farmland.  The 8.3 acre parcel number 0509-331-8050-0 would be rezoned from A-1 Ex to A-2 (8).  No new building sites would be created.  There would be a recorded easement from the exiting driveway to the 53-agricultural farm field zoned A-1 Ex.  Duffin informed the petitioners that Dane County is in the process of changing their Chapter 10 Zoning Codes. This change could be either RR8 or RMS and may happen within the next year.  Duffin explained that there would be no charge to the property owner when this occurs.  An email letter from resident Robert Pultz was read by Duffin which supported this change.  There are no additional splits available on this property at the present time.  The Public Hearing for David and Lynn Stiklestad was closed.

  1. Commercial Rezone Request.  Petition #DCPREZ-2018-11315.  Parcel #0509-132-8676-0; 1088 Union Road, Oregon, WI  53575.  The request is to downzone deed restricted commercial zoning to limited commercial for landscaping business and existing single-family residence.  Owner is Benjamin Johnson, 1088 Union Road, Oregon, WI  53575.  Applicant is Jeff Groenier, W125 Amidon Road, Brooklyn, WI  53521. 

Ben Johnson has started a landscaping business and at one time it would include an automotive repair business to be run by his brother.  Jeff Groenier explained that it was a split zoning.  Johnson would now like to rezone to limited commercial (LC).  The automotive business is no longer being considered and structure will be used by Johnson for repairing and maintenance of the landscaping business vehicles and mowers.  Sharon Christensen inquired if a home could be in the LC zoning? A single-family dwelling for the owner/caretaker is acceptable with a conditional use permit which has been applied for. Johnson is planning to build an additional building. Chairman Duffin closed the Public Hearing.   


  1. Call Plan Commission meeting to order.

Chairman Duffin call the Plan Commission to order immediately following the July 17th, 2018 Public Hearing. 


  1. Roll Call.

There was no roll called.  The following Plan Commission Members were present:  Sharon Christensen, Arlan Kay, Arlen Christensen, Dave Hagemann, Andy Blomstrom, Tim Yanacheck, Chairman Brian Duffin and Clerk Denise Arnold.  Town Board Chairman Wayne Ace was also present.

  1. Discussion and possible Recommendation to the Town Board.
  2. Land Division and Rezone Request.  Petition # DCPREZ-2018-11322.  Parcel #0509-331-8050-0; 5571 Bellbrook Rd., Brooklyn, WI  53521. 

Sharon Christensen inquired if a deed restriction should be placed on the property stating that there are no buildable sites.  Duffin said it will automatically be deed restricted by Dane County so it is not required by the Town.  Motion made by Kay and seconded by Yanacheck to approve Petition # DCPREZ-2018-11322 for a land division and rezone with no available building sites. Motion carried.  The Town Board Meeting will be August 7, 2018.  The Dane County Public Hearing will be held on August 28, 2018.  


  1. Commercial Rezone.  Petition # DCPREZ-2018-11315.  Parcel #0509-132-8676-0; 1088 Union Road, Oregon, WI  53575.

Hagemann inquired about a restroom in the existing building.  Duffin explained that the CUP in place is acceptable if the property owner is the only one using the sanitary fixtures.  The restroom is not for commercial public use.   Motion made by Blomstrom and seconded by Hagemann to approve Petition #DCPREZ-2018-11315 and DCPCUP-2018-02430 for the house.  Motion carried. 


  1. Approval of minutes.

Motion made by Arlen Christensen and seconded by Tim Yanacheck to approve the Plan Commission Meeting Minutes from June 19th, 2018.  Motion carried with no corrections or additions. 


  1. Public Comments.

Town Board Chairman Wayne Ace reminded everyone of the Payne and Dolan Quarry Tour to be held on August 1st, 2018, at 5:30 pm.   Clerk Arnold reminded the group of a TDS meeting at Headquarters on Thursday, July 19th at 11:30.  TDS will be available for questions.  Public Utilities are allowed to access the road right of way and are protected by State Statutes. 


  1. Discussion and possible Recommendation to the Town Board re: Draft Zoning Map for Dane County Comprehensive Revision.

Chair Duffin requested to table this recommendation. 


  1. Communications.

Duffin inquired if the impact fee was increased by the Town Board?  Arlen Christensen reported that the Town Board approved an increase in the impact fee to $2,000 beginning January 1, 2019. Blomstrom commented on the weeds at the Petersen location where the Village is going to establish a new sub-division.  Arlan Kay commented on the identification of the weeds. Clerk Arnold shared the noxious weed notice. 


  1. Adjournment.

Motion made by A. Christensen and seconded by D. Hagemann at 7:30 pm.  Motion carried.
