Planning Commission Meeting Minutes

1. Open Public Hearing.
Chairman Duffin called the public hearing to order at 6:35 p.m.
Present: Brian Duffin, Sharon Christensen, Dave Hagemann, Arlen Christensen and Paul Morrison

Also present: Town Board Chairperson Wayne Ace
a. Land Division and Rezone Request. Petition # 11147. Parcel # 0509-093-8001-0; 1207 S. Fish Hatchery Rd., Oregon, WI 53575. The request is to separate existing residence from farmland. No new building sites will be created. The 38 acres, zoned A-1 Ex will be divided and rezoned into Lot 1 with 16 acres, zoned A-2 with existing house and Lot 2 with 22 acres, zoned A-2. Owner and applicant is Paul Morrison, 1239 S. Fish Hatchery Rd., Oregon, WI 53575.
Paul Morrison clarified the business address is 1239 S. Fish Hatchery Rd. and the home address is 1207 S. Fish Hatchery Rd. The home is located behind the business on 38 acres. He is requesting to split the 38 acre parcel into a 22 or 24 acre agricultural parcel and a 16 or 12 acre parcel with the existing home. The petition is for a 16 acre parcel with the existing home, but Morrison is asking the town to also approve a 12 acre option. He has listed the home for sale with both options. This would allow the buyer to choose between 16 acres with unlimited horses or 12 acres which allows one animal unit per acre. Duffin suggested a conditional use permit on the 12 acres for additional animal units. The 16 or 12 acre parcel with the existing home would be zoned A-2. The remaining 22 or 24 acres is requested to be an A-2 zoning, but Morrison said county staff will be recommending an A-4 zoning. There are no splits available on the property. Morrison will retain the business and agricultural parcel. Currently there are two driveways to access the property. One of the driveways would be moved to a different location and an easement recorded. Arlen Christensen has approved the location of the new driveway. The driveway to the house will have additional bump-outs.
Tim Fox, 5669 Bell Brook Rd., asked for a history of the building splits. Morrison said there are additional splits available on the original farmstead, but he doesn’t own them.
There was discussion that it is unlikely the county can approve both options. Duffin said the town will consider the petition as submitted.
b. Land Division and Rezone Request. Petition # 11145. Parcel # 0509-284-9300-0 and 0509-284-9340-0; the property is located north and east of 5664 Bellbrook Rd., Brooklyn, WI 53521. The request is the reconfiguration of 2 lots on certified survey map #11401 on 61 acres. This is a shifting of lot lines. No new building sites will be created. Lot 1 will be 42.76 acres, zoned A-1 Ex. Lot 2 will be 11.0 acres, zoned RH-3, and Lot 3 will be 7.5 acres, zoned RH-2. Owner is Blue Vista Farm LLC, 742 Foxfield Rd., Oregon, WI 53575. Applicant is Eric Grover, 742 Foxfield Rd., Oregon, WI 53575.
Eric Grover, 742 Foxfield Rd., appeared to discuss the land division and rezone request that was presented last month. Mr. Grover spoke with Roger Lane at Dane County Zoning and he didn’t recommend changing the zoning district as discussed last month. The petition is the same as last month. Tim Fox, 5669 Bell Brook Rd., asked for an explanation of the farmland preservation tax credit. Duffin explained that an A-1Ex parcel would be eligible for farmland preservation tax credit if they have a nutrient management plan and conservation plan. Tim Fox rescinded his objection to the petition, but had additional concerns about water and allowing two driveways. Duffin said that it would be difficult to share a driveway due to the ravine and suggested Mr. Fox contact Dane County regarding storm water management. Sharon Christensen clarified there were no changes made to the preliminary certified survey map as presented last month. Duffin suggested last month that Mr. Grover discuss with Dane County the possibility of an A-4 zoning, but the A-4 zoning district would not allow for farmland preservation tax credits. The neighbors were also given an opportunity to speak with Dane County Zoning and able to resolve many concerns. The county will automatically deed restrict Lot 1. Grover explained the location of the lot lines is due to topography of the land.

3. Call Plan Commission meeting to order.
Chairman Duffin called the regular plan commission meeting to order at 7:15 p.m.
4. Roll Call.
5. Discussion and possible Recommendation to the Town Board:
a. Land Division and Rezone Request. Petition # 11147. Parcel # 0509-093-8001-0.
Motion by Arlen Christensen to approve Land Division and Rezone Request, Petition # 11147 with zoning of A-4 on Lot 2 and deed restriction. Seconded by S. Christensen. Motion carried 5-0.
b. Land Division and Rezone Request. Petition # 11145. Parcel # 0509-284-9300-0 and 0509-284-
Motion by Sharon Christensen to approve Land Division and Rezone Request, Petition # 11145 with Lot 1 deed restriction. Seconded by Hagemann. Motion carried 5-0.
c. Land Division and Rezone Request. Petition # 11099. Parcel # 0509-351-9500-5.
Duffin explained the county was correcting the zoning on an adjacent non-conforming parcel, 0509-354-8000-9 from A-1(Ex) to A-2(1). The county wants the town’s input during the 40-day review period. Motion by Arlen Christensen to approve Land Division and Rezone Request, Petition # 11099 as revised by Dane County. Seconded by Hagemann. Motion carried 5-0.
6. Approval of minutes from the last meeting.
Motion by Hagemann to approve the minutes from April 25, 2017. Seconded by A. Christensen. Motion carried 5-0.
7. Public Comments.
Duffin said the plan commission has finished reviewing the text of the comprehensive plan and starting to review different programs. The town will need to have the text revised and hold a public hearing around September or October. The subdivision ordinance would be reviewed near the end of the year. Susan Krebsbach, 1000 Wesley Road, asked if there was anything she needed to complete as she is still interested in creating a conservation subdivision on her property. Duffin said he doesn’t know of anything that needs to be completed.
8. Discussion and possible Action re: Review of the Town Comprehensive Plan.
Transfer of development rights (TDR) will be discussed in June.
9. Discussion of possible Action re: Intergovernmental Boundary Agreement with Village of Oregon.
Chairman Ace said that the boundary agreement has been put on hold.
The next plan commission work session is scheduled for Tuesday, May 30, 2016 at 6:30 p.m. Duffin distributed the Lincoln Road Agreement with the Village of Oregon to be discussed at the Town Board meeting on June 6, 2017. Beth Cox, 1000 Glenway Rd., contacted Brian Duffin because she purchased her property in the 1980’s with the ability to create additional lots, but has been told that she is no longer eligible.
Paul Morrison will be moving out of the Town of Oregon, but is willing to continue with the comprehensive plan review.
