Planning Commission Meeting Minutes

1. Open Public Hearing:
Chair Duffin called the Public Hearing to order at 6:35 p.m. on August 15, 2017.
a. Land Division and Rezone Request. Petition # N/A. Parcel # 0509-042-8051-5; 1611 County Highway D, Oregon, WI 53575. The request is to create one buildable lot and rezone property from A-1 Ex to A-2(8) on 8.9 acres. Owner and applicant is John Brown, 1611 County Highway D, Oregon, WI 53575.
John Brown, 1611 County Highway D, appeared to request creating one buildable home site by rezoning 8.9 acres from A-1Ex to A-2(8) for his son. Dane County will not allow an additional driveway on County Highway D so there will be an easement for the driveway to the new home site. The existing driveway on the south side of the property will be shared by the existing home and new home site. The current driveway to the existing home will become an agricultural driveway pending approval from Dane county. The agricultural driveway will allow semi-trucks to get off the road safely. A density study was completed and the property is allowed one additional home site. The driveway will require a joint driveway agreement. The existing lot on the south side of the property will remain for his daughter to build a house and will also be included in the easement and joint driveway agreement. The remaining land will continue to be farmed. The required easement for the driveway is 24 feet. The driveway will need to meet the requirements for emergency vehicles.

3. Call Plan Commission meeting to order.
Chair Duffin called the regular plan commission meeting to order at 6:47 p.m. on August 15, 2017.
4. Roll Call.
Present: Chairman Duffin, Sharon Christensen, Arlan Kay, Dave Hagemann, Andy Blomstrom and Arlen Christensen. Absent: Paul Morrison.
Also Present: Wayne Ace, Town Board Chairman, Steve Root, Town Board Supervisor and Jennifer Hanson, Deputy Clerk/Treasurer.
5. Discussion and possible Recommendation to the Town Board:
a. Land Division and Rezone Request. Petition # N/A; Parcel # 0509-042-8051-5; 1611 County Highway D, Oregon, WI 53575.
The joint driveway agreement will need to be recorded at Dane County. Duffin explained that a $1,000 impact fee is due to the town, but a county use value fee will not be required since the land division is for family. The joint driveway agreement and $1,000 impact fee are due to the town when requesting the town clerk’s signature on the final CSM. Blomstrom moved, seconded by A. Christensen to approve the land division and rezone request for parcel # 0509-042-8051-5 requiring a joint driveway agreement to be recorded with the final CSM and $1,000 Impact Fee. Motion carried 6-0.
6. Approval of minutes from the last meeting.
Christensen moved, seconded by Hagemann to approve the Plan Commission Meeting Minutes from July 18, 2017. Motion carried 6-0.
7. Public Comments.
Joel and Ruth McNair, 5792 Alpine Rd., appeared to report that they have been unsuccessful in obtaining a joint driveway agreement with adjoining property owners. They have accepted an offer to purchase their lot that doesn’t require a joint driveway agreement because it’s a cash offer. However, the buyer has two contingencies. The first is the buyer is to obtain written verification that there is legal vehicular access from property to public roads and the second is the seller provide evidence that the building permit will not require alterations to current drive access. Joel McNair is requesting the town provide a letter to satisfy these two contingencies. There was discussion about the possible building location on the property. Duffin said the driveway is grandfathered and therefore the town cannot enforce a joint driveway agreement or require alterations to widen the driveway. Joel McNair said they are close to reaching a joint driveway agreement with the neighbors. The town board will hold a special meeting next week to discuss the McNair’s request for a letter from the town. The new house will need to follow the current town driveway ordinance.
8. Discussion and possible Action re: Transfer of Development Rights (TDR) and RH policy 1f.
Duffin is combining Item 8 & 9. Duffin said the plan commission is almost finished with an update on the town’s comprehensive plan and completing the research on TDR and RH policy 1f. The town board will need to provide the plan commission with direction on the options for TDR and RH policy 1f. Duffin would like to have a joint meeting with the Town Board after one more plan commission work session. A review of the conservation subdivision ordinance will start in October 2017. The town board will also need to provide direction on hiring either MSA or Dane County to complete the update on the comprehensive plan. Duffin discussed the Town of Rutland’s policy on handling of TDR requests on a case by case basis. Deputy Clerk Hanson will ask Majid Allen to attend the next plan commission work session on Tuesday, August 29. Duffin also discussed possible requirements for a shooting range. The Dane County Zoning Chapter 10 Ordinance Revision meeting will be held on Monday, August 28. Duffin would like to amend the RH policy 1f from what was proposed a few years, but will present to the town board for direction.
9. Discussion and possible Action re: Review of the Town Comprehensive Plan.
10. Set date for plan commission work session.
The next plan commission work session will be held on Tuesday, August 29, 2017.
The Payne & Dolan site visit will be held on Wednesday, August 23. Chairman Ace would like the plan commission to discuss next month creating a winter parking ordinance in the town.
