Planning Commission Meeting Minutes

1. Open Public Hearing:
Town of Oregon Plan Commission Chairman Duffin called the public hearing to order on Tuesday, July 19, 2016 at 6:35 p.m.
Members present: Paul Morrison, Tom Wiedenbeck, Dave Hagemann, Brian Duffin and Arlan Kay, Andy Blomstrom and Sharon Christensen.
Also present: Town Board Supervisor Arlen Christensen and Treasurer/Deputy Clerk Jennifer Hanson. 18 people in attendance.
a. Land Division and Rezone Request. Petition # DCPREZ-2016-11018; Parcel #0509-271-8220-3, 0509-271-8720-8; 0509-271-9000-7 & 0509-272-8030-2; North and West of 509 Glenway Road. The request is to create two buildable parcels and rezone. Lot 1 would be 16.3 acres and rezoned from A-1Ex to A-2. Lot 2 would be 14.5 acres and rezoned from A-1Ex to A-2(8). Petitioner is Chase O’Brien, 2594 Leopold Way #113, Sun Prairie, WI 53590. The Owner is O’Brien Family Irrev Tr., 509 Glenway Road, Brooklyn, WI 53521.
Chase O’brien, 2594 Leopold Way #113, Sun Prairie, WI, appeared to discuss creating two buildable parcels for him and his sister, Lacey, on family farmland. The land is zoned A-1 Ex and would be rezoned to A-2. The parcels will be approximately 14 ½ and 16 ½ acres. The parcels will share a driveway that will run along the north fence line that borders their property. The farm is currently rented out for corn and they would like to maintain as much of the farmland as possible. They would like the driveway to be close to the fence line. Chase’s home would be set back 300 feet from Glenway Road and Lacey’s home would be set back further along the flag pole in the middle of the flag outside of the woods. The density study determined there are 4 density units available and they will use 2. There is a field driveway on Dan and Mark O’brien’s property on the south side of the fence line. The fence has been there for many years and may not sit exactly on the lot line. Chase said if the driveway was put 10 feet off the fence line, then it would leave a 30 feet of the empty space and would cut into the farmland. Chase discussed a driveway variance to allow the driveway to be placed closer to the fence. There are no plans to remove the fence. The property will be surveyed to determine the lot line. Duffin said the driveway will not bisect farmland. Chase’s home would be placed in a location for farm equipment to have access to the fields. There was discussion regarding the bump outs required on driveways over 500 feet. The application has been made at the county. There were no objections to the petition.
b. Rezone and CSM Approval Request. Petition # Not Available; Parcel # 0509-154-8500-6 & 0509-154-8900-2; 936 & 956 Glenway Road, Oregon, WI 53575. The request is for a lot line adjustment of 2.62 acres and rezone. The property at 936 Glenway Road (Lot 1) is currently 4.24 acres, zoned A-2 and will be adjusted to 6.86 acres, zoned A-2(4). The property at 956 Glenway Road (Lot 2) is currently 9.91 acres, zoned RH-3 and will be adjusted to 7.28 acres, zoned RH-2. Petitioner and Owner is John Mullarkey, 936 Glenway Road, Oregon, WI 53575 and Pamela Mullarkey, 956 Glenway Road, Oregon, WI 53575.
John Mullarkey, 936 Glenway Road, appeared to request adjusting lot lines with his brother’s estate for buildings to be on his land. The properties are side by side. The surveying has been completed. The zoning would change due to acreage. There are no driveway issues. John said the surveyors have been taking care of the county application. There were no objections to the petition.
2. Close Public Hearing.
Duffin closed the public hearing at 6:55 p.m. and went directly into the regular plan commission meeting.
3. Call Plan Commission meeting to order.
Chairman Duffin called the regular plan commission meeting to order at 6:55 p.m.
4. Discussion and possible Recommendation to the Town Board:
a. Land Division and Rezone Request. Petition # DCPREZ-2016-11018; Parcel #0509-271-8220-3, 0509-271-8720-8; 0509-271-9000-7 & 0509-272-8030-2; North and West of 509 Glenway Road.
Motion by Hagemann to approve Land Division and Rezone Request; Petition# DCPREZ-2016-11018; Parcel #0509-271-8220-3, 0509-271-8720-8; 0509-271-9000-7 & 0509-272-8030-2; North and West of 509 Glenway Road. Seconded by Wiedenbeck. Motion carried 7-0. Duffin explained that an impact fee of $1,000.00 per lot would be due to the town at the time the final CSM is signed at the clerk’s office. Duffin mentioned that Dane County may charge a use value fee based on acreage, however family maybe exempt.
b. Division and Rezone Request. Petition # DCPREZ-2016-11018; Parcel #0509-271-8220-3, 0509-271-8720-8; 0509-271-9000-7 & 0509-272-8030-2; North and West of 509 Glenway Road.
Motion by Morrison to approve Land Division and Rezone Request; Petition# DCPREZ-2016-11018; Parcel #0509-271-8220-3, 0509-271-8720-8; 0509-271-9000-7 & 0509-272-8030-2; North and West of 509 Glenway Road. Seconded by Wiedenbeck. Motion carried 7-0.
5. Approval of minutes from the last meeting.
Motion by Wiedenbeck to approve the minutes from last meeting. Seconded by Hagemann. Motion carried 7-0.
6. Public Comments.
Spenser Johnson, 6295 Lacey Road, appeared for Payne & Dolan to give an update on the Wingra LLC site development adjacent to the Klahn site. The site will be opened in early August and it will take about three months to complete the build up all the berms. They may start mining before the end of the year. Once things get going they will offer a tour to the board. The Klahn site will be reclaimed next year. The new site will be 31 acres and 2/3 will continue to be farmed until they get to those areas.
Donald and Debra Tofte, 5431 Lincoln Road, appeared to request an additional home on their property of 20 acres. The property is within ETJ of the Village of Oregon. They meet with the Village of Oregon planner, Mike Slavney and he didn’t have an issue with another house on the southwest corner of the property. They would like to split into two farmettes and keep the land in agriculture. They have developers looking at their property and possible annexation into the village. The density study determined there are no splits available to build another house, but the property could be rezoned. Duffin said the plan commission wouldn’t be able to recommend approval for an additional home because the density study doesn’t allow another home. Duffin said the current house could be replaced to a different spot of the property. There was discussion of the original farmstead splits. This parcel was created prior to 1994, so it is not eligible for additional splits. The town is not in a position to allow another house on the property under the current land use plan. Jerry Jensen asked if the land use plan could be amended to allow 1 house per 20 acres. There was discussion of transfer of development rights (TDR). Duffin asked Wiedenbeck to check with the town board if they can discuss TDR along with conservation subdivisions and opt out of county zoning at the joint meeting in August.
7. Discussion Only re: Conservation Subdivision and Wisconsin Act 178 Opt Out of Dane County Zoning.
The joint meeting with the town board and plan commission is set for Tuesday, August 23, 2016 at 6:30 p.m.
8. Discussion and possible Action re: TORC procedures.
There were no updates on the TORC.
9. Update on Anderson Park.
Arlen Christensen said the Anderson Park meeting is tomorrow night.
Hanson gave an overview of the section maps and zoning maps and other information shared by Roger Lane at Dane County. The Dane County zoning subcommittee has asked to use the town hall to hold a meeting in November.
