Plan Commission Meeting Minutes

1. Open Public Hearing:
Town of Oregon Plan Commission Chair Weber called the public hearing to order on Tuesday, July 15, 2014 at 6:30 p.m. In attendance were Darryl Weber, Tom Wiedenbeck, Paul Morrison, Andy Blomstrom, Brian Duffin, Sharon Christensen and Deputy Clerk Jennifer Hanson. Absent Dave Hagemann.
a. Land Division and Rezone Request; Petition # Not Available; Parcel # 0509-243-9070, 0509-243-9650 & 0509-243-9000. The request is to divide property into two lots. Lot 1 would be a buildable site for son on 16 acres, zoned A-2. Lot 2 would be 20 acres with existing home and re-zoned to A-2. Lot 1 would be located on the corner of Rome Corners Road and Union Road, adjacent to existing home. The land is currently zoned A-1 Ex. Petitioner and Owner is Warren and Peg Schmidt, 4965 Rome Corners Rd., Brooklyn, WI 53521.
Warren and Peg Schmidt, 4965 Rome Corners Rd., Brooklyn, WI 53521, appeared to discuss their request to divide their property into two parcels. The property would be split into Lot 1 with 16 acres for a buildable site and Lot 2 with 20 acres for existing house. Both lots would be zoned A-2. Warren would like his son to take over the farming duties. The land is currently in the conservation reserve program (CRP), but will go off this year. The purpose of the division is to create a lot for their son. Warren chose A-2 zoning based of recommendation from Dane County and surveyor. The land is 30% class II, 60% class IV and 10% class VII, so he would like the house, road and septic tank to be put on the less productive land. However they won’t know where that is until they start to dig because the land has been in CRP for 15 years. Warren would also like a reasonable driveway on Rome Corners Rd. A-2 is an appropriate zoning because they derive agricultural income from the property.
2. Close Public Hearing.
Weber closed the public hearing at 6:38 p.m.
3. Call Plan Commission meeting to order.
Immediately following the close of the public hearing, Weber called the regular plan commission meeting to order.
4. Discussion and possible Recommendation to the Town Board:
a. Land Division and Rezone Request; Petition # Not Available; Parcel # 0509-243-9070, 0509-243-9650 & 0509-243-9000.
Duffin made Warren aware that the town has a $600 impact fee on the creation of a buildable lot. Duffin also said the driveway location would be reviewed when there is a request for the house. Warren has also applied with the Village of Oregon because it is within the extraterritorial zoning. Motion made by Christensen to approve Land Division and Rezone Request for Parcel #’s 0509-243-9070, 0509-243-9650 & 0509-243-9000 to create two lots, one 16 acres and the other 20 acres, and seconded by Duffin. Motion carries.
5. Approval of minutes from the last meeting.
Motion made by Duffin and seconded by Christensen to approve the June 17, 2014 meeting minutes. Motion carries.
6. Public Comments.
Jerry Granger and his son-in-law, Scott Faust, 6163 Oak Hollow Drive, appeared to discuss dividing the land at 6100 County Road D. Mr. Granger purchased the 51 acre property intending to move closer to his daughter and son-in-law. However, they have been unable to sell their current home and would like to separate the house, shed and 9 acres to sell. He would keep the remaining 42 acres that abut the Faust property. A driveway easement would need to be in place before the land is divided. There was discussion if a buildable site is available. The plan commission recommended completing a density study at Dane County to confirm if a building site is available. The land division process was explained.
7. Discussion and possible Action: Amending Comprehensive Land Use Plan to include shared driveway easement ordinance approved by Dane County.
Dane County has not yet acted on the shared driveway easement ordinance.
8. Discussion and possible Action re: TORC procedure.
No updates on the TORC.
9. Update on Anderson Park.
The portable toilet at Anderson Park will remain because of the upcoming work days.
Blomstrom would like to put pressure on Charter Communications to fix the poles on Fish Hatchery Road. Weber said Alliant doesn’t want Charter on their poles. Blomstrom will look into contacting elected officials.
Christensen asked about the plan commission approving the condominium declarations on the Purdin property. Duffin asked if the town specified the permitted uses of the property. Christensen would like the see the condominium declarations before the next building permit is issued.
Weber informed the plan commission that a Village resident wants to reduce the speed limit on Lincoln Road from 55 mph to 45 mph. The resident rides his bicycle and feels a reduction in the speed limit would increase safety. The resident has offered to pay for the new speed signs. Weber asked how the plan commission members feel about that offer. The members agree that they represent the interest of the town residents. The town has agreed to donate $18,000 to the bike path in the Village of Oregon.
Motion made by Duffin and seconded by Christensen to adjourn the meeting at 7:53 p.m. Motion carries.
