Plan Commission Meeting Minutes

Tuesday, August 19, 2014

 

1.         Open Public Hearing:

Town of Oregon Plan Commission Chair Weber called the public hearing to order on Tuesday, August 19, 2014 at 6:30 p.m.  In attendance were Darryl Weber, Tom Wiedenbeck, Paul Morrison, Andy Blomstrom, Dave Hagemann, Brian Duffin, Sharon Christensen and Deputy Clerk Jennifer Hanson.

 

a.                  Land Division and Rezone Request; Petition # DCPREZ-2014-10753; Parcel # 0509-074-8001-0; 6100 County Highway D, Oregon, WI  53575.  The request is to divide property into two lots.  No building sites will be created.  Lot 1 would be the existing home and outbuilding on 8.9 acres, zoned RH-3.  The remaining 42 acres would be zoned A-1 Ex.  Petitioner and Owner is Gerald Granger, 6100 County Highway D, Oregon, WI  53575.

Gerald Granger, 26635 Rocky Branch Lane, Richland Center, WI, appeared to discuss dividing the property at 6100 County Highway D into two parcels.  The first parcel would be 9 acres with the home and outbuildings.  The second parcel would be 41 acres without buildings.  A density study was completed and there are no building sites available.  Phil Johnson, 6080 County Road, lives next door and appeared to ask why the lot line wasn’t run straight back to the house.  No objections were heard.

 

2.         Close Public Hearing.

Weber closed the public hearing at 6:35 p.m.

 

3.         Call Plan Commission meeting to order.

Immediately following the close of the public hearing, Weber called the regular plan commission meeting to order.

 

4.         Discussion and possible Recommendation to the Town Board:

a.                  Land Division and Rezone Request; Petition # DCPREZ-2014-10753; Parcel # 0509-074-8001-0; 6100 County Highway D, Oregon, WI  53575. 

Weber clarified that the intent was to sell the 9 acres with the home and outbuildings.  The additional 41 acres would be sold to his son-in-law and daughter whose property adjoins the land.  Mr. Granger may still move to the property if his home in Richland Center were to sell.  Christensen question a 2.5 acre piece of land on the certified survey map that is being rezoned from RH-1 to A-1Ex.  This is a mistake caught by Dane County Zoning that is being fixed.  Weber said a shared driveway easement would need to be recorded because the county may not issue another driveway permit.  Motion made by Blomstrom to approve Land Division and Rezone Request; Petition # DCPREZ-2014-10753 and seconded by Duffin.  Motion carries.  Weber asked for Mr. Granger to attend the September 2, 2014 town board meeting. 

 

5.         Approval of minutes from the last meeting.

Motion made by Duffin and seconded by Christensen to approve the July 15, 2014 meeting minutes.  Motion carries.

 

6.         Public Comments.

There were no public comments.

 

 

 

 

7.         Discussion and possible Action re: Purdin condominium permitted uses.

Duffin asked Mr. Purdin for clarification on the permitted uses for the condominiums being constructed on Union Road.  Mr. Purdin purchased the property with unrestricted C-2 zoning and was not required to rezone the property.  Therefore the town didn’t have an opportunity to review the permitted uses.  This caused confusion because normally commercial uses are restricted within the town.  Mr. Purdin provided a copy of the Declaration of Covenants for the three buildings.  The declaration restricts permitted uses such as; anything prohibited by local zoning code, no sleeping, no tattoo or body piercing shops, no sale of pornographic material, no retail sales and high water use businesses must be approved by association.  Mr. Purdin intends for the condominiums to be for personal hobbyist use only, but is not restricting all commercial uses.  The plan commission expressed concern about future uses of the property.  Mr. Purdin expects the buildings to remain within the family.  He also explained that the layout of the buildings restricts many uses and there is little parking available.  Mark Genin discussed the history of the property and explained it was zoned C-2 many years ago.  Weber feels the buildings will be a great asset to the community.     

 

8.         Discussion and possible Action re: TORC procedure.

No updates on the TORC.

 

9.         Update on Anderson Park.

There is one more workday scheduled at the park.  A small wooden sign maybe installed.  Weber said the discussion of athletic fields has been dropped and the town is opposed.

 

10.     Communications.

Blomstrom was thankful for the follow up on the Charter cable lines on Fish Hatchery Road.  The lines will be buried next year.

 

Deputy Clerk Hanson asked for clarification on issuing driveway permits.  Currently the driveway permits are issued by Abel Schultz, but not approved by the plan commission or town board.  The plan commission discussed working with Abel on driveway permit applications in the future.   

 

11.     Adjournment.

Motion made by Christensen and seconded by Hagemann to adjourn the meeting at 7:25 p.m.  Motion carries.
