Plan Commission Meeting Minutes

1. Open Public Hearing:
Town of Oregon Plan Commission Chair Weber opened the public hearing at 6:30 p.m. on Tuesday, October 15, 2013. In attendance were Darryl Weber, Tom Wiedenbeck, Paul Morrison, Andy Blomstrom, Dave Hagemann, Brian Duffin, Sharon Christensen and Deputy Clerk, Jennifer Hanson. Also in attendance were Town Board Supervisors Steve Root, Wayne Ace and Fred Clark.
a. Land Division and Rezone; Petition # DCPREZ-2013-10580 & 10577; Parcel # 0509-242-8570-0 & 0509-133-9080-0 & 8760-0. The request is to separate three existing residences from vacant land. The property is zoned A-3 and the request is to rezone to 7.7 acres to RH-2 & .9 acres to R-1, 7.9 acres to RH-2 and 17.2 acres to RE-1. No building sites will be created. The properties are located at 875 Union Road, 4998 Locust Grove Road and 805 Union Road. Brooklyn, WI 53521. Applicant is County of Dane, 5201 Fen Oak Drive, Madison, WI. Owner is Patricia Anderson, 875 Union Road, Oregon,WI 53575.
Laura Guyer, Dane County Real Estate & Acquisition Director, appeared to discuss the request to facilitate separation of the existing buildings from the vacant land. The Anderson family is in the process of selling most of the vacant land to Dane County for Anderson County Farm Park and retaining all of the buildings. The county is requesting a rezone of the properties. Ms. Guyer presented a map of the project. There are two separate requests. The first petition #10577 is separating Pat Anderson’s house and the blue tenant house, both which are north of Locust Grove Road. Petition #10577 would create three lots; Lot 1 is the blue tenant house with 2 acres to be zoned R-1, Lot 2 is Pat Anderson’s house with 8 acres to be zoned RH-2 and Lot 3 is transferred to the county with 17.2 acres to be zoned RE-1. The second petition #10580 is the original farmstead house south of Locust Grove Road. Petition #10580 would create two lots; Lot 1 is the original farmstead and buildings with 8.1 acres to be zoned to RH-2 and Lot 2 is transferred to the county with 34.8 acres to be zoned to RE-1. All land transferred to the county would be zoned RE-1. Duffin suggested a zoning of RH-3 instead of RH-2 on Lot 1 of Petition #10580 due to the acreage size. Duffin also asked about the intended use of the RE-1 zoned property. Laura Guyer presented an overview of the intended uses. The area north of Locust Grove Road would stay in agricultural with the possibility of a small parking lot. The area south of Locust Grove Road would be part of the agricultural learning center with agricultural related activities, such as community gardens, pumpkin patches or anything about the heritage of the farm. Duffin would like to deed restrict the permitted use of residence for an owner or caretaker on the county property. Duffin also wants to restrict the conditional use of lighting of recreational facilities. The county will discuss any changes in the use of the land with the town. The county is developing the park slowly. The next part of the park to be developed would be on the south side for the dog exercise area. The park is slightly land locked as the family chose to retain about 38 acres of land.

3. Call Plan Commission meeting to order.
Weber called the plan commission to order at 6:45 p.m.
4. Discussion and possible Recommendation to the Town Board:
a. Land Division and Rezone; Petition # DCPREZ-2013-10580 & 10577.
Blomstrom clarified that the snowmobile trail will still be accessible. Hagemann asked if any skeet, trap, rifle and pistol ranges will be used on the property. The county doesn’t see permitting any of these uses, but the county is issuing permits for bow hunting. Duffin suggested deed restricting all the permitted uses on the county property until a plan is presented. Hagemann asked about the county operating a snowmobile rental service or other rental service. The county doesn’t plan to operate any type of rental service. The county is hoping to lease some of the buildings already on the property and not need to build any additional buildings. The plan commission discussed the zoning of the county property to A-3 instead of RE-1. The county would need to come back to the town if they wanted to construct a baseball or soccer field and go through the public hearing to have the deed restrictions lifted. Motion made by Hagemann to approve Petition # DCPREZ-2013-1580 & 10577 under the assumption that all the permitted uses are treated as deed restricted; anything going to RE-1 restricts all permitted uses as deed restricted and the county will need to come back to the town to lift the deed restrictions; Under Petition # 10580 Lot 1 will be rezoned to RH-3 and not RH-2. Seconded by Duffin. Motion carries.
5. Approval of minutes from the last meeting.
Motion made by Christensen and seconded by Hagemann to approve the September 17, 2013 meeting minutes. Motion carries.
6. Public Comments.
There were no public comments.
7. Discussion and possible Action re: TORC procedures.
Everything is going well at the TORC.
8. Update on Anderson Park.
Weber reported that the culvert at the Anderson Park will be installed by the town road crew and reimbursed by the county. Steve Root will attend the Friends of the Anderson park meeting on Thursday.
Hanson presented information on the AT&T cell tower to be on next month’s agenda.
Motion made by Hagemann seconded by Duffin to adjourn the meeting at 7:15 p.m. Motion carries.
