Plan Commission Meeting Minutes

1. Open Public Hearing:
Town of Oregon Plan Commission Chair Weber opened the public hearing at 6:30 p.m. on Tuesday, June 18, 2013. In attendance were Darryl Weber, Tom Wiedenbeck, Dave Hagemann, Brian Duffin, Sharon Christensen, Paul Morrison, Andy Blomstrom and Deputy Clerk, Jennifer Hanson.
a. Land Division and Rezone; Petition # DCPREZ-2013-1056-6; Parcel # 0509-353-8690-0 request is to separate existing residence from farm land. The property is zoned A-1Ex (36.2 acres) and RH-1 (2.0 acres). The request is to rezone 24.8 acres to A-1Ex to sell to adjoining land owner and 13.213 acres to RH-3. No building sites will be created. The property is located at 120 Glenway Road, Brooklyn, WI 53521. Petitioner and Owner Joanne Huston, 120 Glenway Rd., Brooklyn, WI 53521.
b. Land Division and Rezone; Petition # DCPREZ-2013-1056-7; Parcel # 0509-353-8690-0 request is to separate existing residence from farm land. The property is zoned A-1Ex (36.0 acres) and RH-1 (2.0 acres). The request is to rezone 24.87 acres to A-1Ex to sell to adjoining land owner and 12.827 acres to RH-3. No building sites will be created. The property is located at 172 Glenway Road, Brooklyn, WI 53521. Petitioner and Owner Robert Halbleib, 172 Glenway Rd., Brooklyn, WI 53521.
Mark O’Brien, 552 Glenway Rd., explained that he and his brother, Dan plan to purchase 25 acre parcels from Joanne Huston, 120 Glenway Road and Robert Halbleib, 172 Glenway Road. The land is contingent with their farmland. They currently rent the land for farming and will continue to farm the land. No building sites will be created. The 25 acre parcels will remain zoned A-1Ex. The remaining acreage will be rezoned to RH-3 and continue its current usage. No public comments.

3. Call Plan Commission meeting to order.

4. Discussion and possible Recommendation to the Town Board:
a. Land Division and Rezone; Petition # DCPREZ-2013-1056-6; Parcel # 0509-353-8690-0.
b. Land Division and Rezone; Petition # DCPREZ-2013-1056-7; Parcel # 0509-353-8690-0.
Robert Halbleib, 172 Glenway Rd., explained that properties with less than 15 acres are covered under the Freddie Mac and Fannie Mac home loan programs and eligible for a standard 30 year fixed rate home loan. This land division will make their homes more marketable in the future. Motion made by Hagemann and seconded by Christensen to approve the Land Division and Rezone; Petition #DCPREZ-2013-1056-6 & DCPREZ-2013-1056-7 to take 25 acres out of each property for sale to O’Brien and leaving the remainder with current homeowner and rezone to RH-3. Motion carries.
5. Discussion and possible Recommendation to the Town Board re: Nonresidential Site Plan Review; Purdin Enterprises, Storage Condominium on Union Road; CSM 10073.
Jim Purdin, 899 Katie Lane, shared with the Plan Commission a nonresidential site plan review for storage condominiums on Union Road. He plans to build three commercial condominium buildings with 2 units in each building. Purdin would own building one to store his car collection. To recover some of the expense he would offer the other two building for sale. The current zoning of C-2 allows for this type of project and will not require a rezone. Phase 1 of the project would establish a driveway and building one with 2 storage units. Phase 2 would include the construction of the other two buildings and creation of the condominium declaration. Purdin expects to start construction on his building sometime this summer. Phase 2 could begin later this year or sometime next year. Purdin has met with the Village because they have extraterritorial jurisdiction. Upon creating the condominium agreement, both the town and village would need to approve the usage and restrictions to the site. There was discussion about the lighting meeting the town specifications. There will be only two parking places in the front of each unit. The Plan Commission doesn’t need to approve the nonresidential site plan review until the condominium documents are created.
6. Approval of minutes from the last meeting.
Motion made by Christensen and seconded by Wiedenbeck to approve the May 21, 2013 meeting minutes. Motion carries.
7. Public Comments.
There were no public comments.
8. Discussion and possible Action re: Alliant tree planting on Netherwood Rd.
Betty Kluever, 5822 Madsen Circle, asked if the road crew could remove the box elder tree that was cut down on Madsen Circle, but has regenerated and is unruly. Weber will follow thru with Abel. Andy Blomstrom said the tree planting went really well. He purchased three additional trees and everything looks nice. The final bill from Winterland Nursery was $2,850. The neighbors are watering the trees.
9. Discussion and possible Action re: TORC procedures.
Everything is working well. The town is still looking for someone to replace Sam.
10. Discussion and possible Action re: Town’s Submittal Application for Land Division, Rezones, and CUP.
The new submittal form will be used with the next rezone application.
Weber informed the board that a group of neighbors have requested to purchase park equipment for the Della Road Park. The residents found park equipment on Craig’s List from a daycare going out of business. Paul Morrison commented that the Art Fair had over a 1,000 visitors.
Motion made by Christensen seconded by Duffin to adjourn the meeting at 7:18 p.m. Motion carries.
