Plan Commission Meeting Minutes

Monday, March 19, 2012


1.         Open Public Hearing:

Town of Oregon Plan Commission Member Duffin, in absence of Chair Weber, opened the public hearing at 6:30 p.m.  Chairman Weber was absent because he is attending a Dane County meeting on the Anderson County Park.  In attendance were Paul Morrison, Tom Wiedenbeck, Dave Hagemann, Brian Duffin, Sharon Christensen, and Jennifer Hanson, Deputy Clerk.  Darryl Weber and Andy Blomstrom were absent.

a.                  CUP Amendment; Petition # DCPCUP-2012-02198; Parcel # 0509-163-9500-3.  The request is to amend CUP conditions on A-1 Entertainment zoning to allow for an additional building.  The property is located at 848 Tipperary Road, Oregon, WI  53575.  Petitioner and Owner is Greg Hann, 200 N. Monroe St., Stoughton, WI  53589.

Greg Hann from Hann Christmas Tree Farm at 848 Tipperary Road explained that he is zoned A-1 Ex with a conditional use permit (CUP) for agricultural entertainment.  In keeping with compliance with the CUP conditions Mr. Hann needs to reopen the CUP, pay the fees and then close the CUP to build any buildings or additions.  He is not looking to add anything additional to what he is currently doing on the farm.  The only thing he is changing is the site plan by adding a 34 X 70 structure to the west side of the existing building for a larger area for customers.  He is not changing the hours of playing the music or hours of operation.  He needs wider aisles for the customers.  He is not adding inventory.  He will continue with the same business, but just wants more space for customers.  Member Duffin read the conditions of the current conditional use permit.  The new structure will join with the existing structure.  Mr. Hann will work with the fire inspector and the building inspector, but will not have a commercial building.  The fire inspector will not allow a commercial business to have any live greens in a commercial building.  Therefore Mr. Hann would not be able to operate his business because he couldn’t make any wreaths or store Christmas trees.  Dane County allows his business to be zoned agricultural.

b.                  Land Rezone; Petition Land Rezone; Petition # N/A; Parcel # 0509-132-8676-0.  The request is to rezone property from C-1 to C-2 including automotive repair.  The property is located at 1088 Union Road, Oregon, WI  53575.  Petitioner and owner is Richard Lofy, 203 Madelia Pl, Mooresville, NC  28115.  Agent is Mark Genin, 1090 Union Road, Oregon, WI  53575.

Mark Genin, agent for Mark Lofy, appeared to discuss rezoning the property at 1088 Union Road to operate an automotive repair shop.  Mr. Genin explained that Steve has been operating an automotive repair shop at this location for over a year and Steve plans to purchase both the home and the shop.  Member Duffin read the current deed restrictions and explained the need to change the zoning to allow for an automotive repair business.  There was discussion about the number of employees needed and the type of businesses to allow without being too restrictive.  

2.         Close Public Hearing.

Duffin closed the public hearing at 6:55 p.m.

3.         Call Plan Commission meeting to order.

Duffin called the Plan Commission meeting to order at 6:55 p.m.

4.         Discussion and possible Recommendation to the Town Board:

a.                  Hann, Greg; CUP Amendment; Petition # DCPCUP-2012-02198 Parcel # 0509-163-9500-3. 

The Plan Commission expressed their support for local businesses.  Motion byHagemann to recommend the Town Board approve Petition # DCPCUP-2012-02198 to amend the conditional use permit (CUP) at 848 Tipperary Road to allow for a building addition and second by Christensen.  Motion carried.

b.                  Lofy, Richard; Land Rezone; Petition # N/A.  Parcel # 0509-132-8676-0. 

The Plan Commission discussed the uses allowed in a C-2 zoning.  Mr. Genin doesn’t want the deed restrictions to be too restrictive.  The Plan Commission decided to amend the current deed restrictions.  Motion by Hagemann to recommend the Town Board approve Petition # N/A to rezone 1088 Union Road from C-1 to C-2 with the following deed restrictions:

  1. The land uses shall be limited to retail/wholesale general and mechanical contracting services, including plumbing, electrical, woodworking and major repairs to motor vehicles.
  2. No more the 40% of the C-2 zoning lot shall be covered with building structures.
  3. Office hours shall be limited to 6 am to 6 pm, Monday through Saturday.
  4. Business shall be limited to (6) six employees.
  5. Outside parking shall be limited to 12 vehicles at one time.

Motion seconded by Wiedenbeck.  Motion carried.

5.         Approval of minutes from the last meeting.

Motion by Wiedenbeck and seconded by Christensen to approve the Plan Commission meeting minutes of February 27, 2012.  Motion carried.

6.         Public Comments.

There were no public comments.

7.         Discussion and possible action re:  Town’s Submittal Application for Land Division, Rezones and CUP.

There were no updates on this item.

8.         Communications.

Deputy Clerk Hanson will contact Brian Standing and Andrew Bremer to attend either the April or May Plan Commission meeting to discuss Policy 1f under Agricultural Elements in the Town’s Comprehensive Plan.  Wiedenbeck got a call from someone that wants to take down a cell tower.  He wondered what the town would require to do this.  The Plan Commission discussed, but referred the question to Dane County Zoning.

9.         Adjournment.

Motion by Christensen and seconded by Hagemann to adjourn the Plan Commission meeting at 7:30 p.m. on Monday, March 19, 2012.  Motion carried
