Plan Commission Meeting Minutes

1. Open Public Hearing:
Town of Oregon Plan Commission Chair Weber opened the public hearing at 6:30 p.m. In attendance were Darryl Weber, Paul Morrison, Tom Wiedenbeck, Andy Blomstrom, Dave Hagemann, Brian Duffin, Sharon Christensen and Deputy Clerk, Jennifer Hanson.
a. Land Division & Rezone Petition # DCPREZ-2012-10339; Parcel # 0509-084-9501-0.
Steve Clark, 150 Paoli Street, Verona, WI appeared to discuss his request to create 2 buildable sites on his father’s farm for him and his brother. The building sites would be a 2.7 acre parcel zoned A-2 and 2.2 acre parcel zoned RH-1. The plan commission reviewed the proposed CSM map. The 2.7 acre property is zoned A-2 because the intent is to have a machine shed for tractors and possible animals. The properties will share a driveway and have a shared driveway agreement. The 66 feet of road frontage shown on the map wouldn’t be used as a driveway, but is drawn to meet the county’s requirements that every parcel contain 66 feet of road frontage. There were no questions from the audience.

3. Call Plan Commission meeting to order.
Weber called the Plan Commission meeting to order at 6:40 p.m.
4. Discussion and possible Recommendation to the Town Board:
a. Land Division & Rezone Petition # DCPREZ-2012-10339.
No questions from the Plan Commission members. Motion made by Blomstrom and seconded by Wiedenbeck to approve Land Division & Rezone Petition #DCPREZ-2012-10339. Motion made by Hagemann and seconded by Christensen to amend the original motion to include the driveway agreement and impact fee. Motion carries.
5. Approval of minutes from the last meeting.
Motion made by Wiedenbeck and seconded by Duffin to approve the minutes from the Monday, December 19, 2011 meeting. Motion carries.
6. Public Comments.
Dale Secher, 5683 Lincoln Road, appeared to discuss a change in zoning from A-2 to A-1 on parcel # 0509-162-9501-3 and combined it with parcel # 0509-162-9551-3. The zoning was changed during the blanket rezone and because the ownership names are different Dane County didn’t recognize the contiguous ownership. The property no longer qualifies for farmland preservation tax credits as currently zoned. The property owners plan to change the name of ownership on all the parcels. The plan commission approved the request, but formal approval will be at the next plan commission meeting.
Andrew Bremer, town planner, appeared to clarify changes to the Comprehensive Plan and Farmland Preservation Plan. Mr. Bremer discussed the Bebber-Wells property located on 6112 County Highway A. The Bebber-Wells are requesting that their property be rezoned from A-2(8) to A-1 Ex. The zoning was changed during the blanket rezone and the property no longer qualifies for farmland preservation tax credits. The plan commission reviewed the town’s Proposed Land Use map. Mr. Bremer explained that the town needs to publish a Class 1 notice with 30 days to changes to the Comprehensive Plan and the town also needs to hold a public hearing on the rezones of the Bebber-Wells and Secher properties next month.
Duffin explained that he was concerned about Policy 1f under Agricultural Element on page 30 of the Comprehensive Plan. Properties zoned RH before December of 1994 when the town adopted exclusive agricultural were entitled to splits that they may no longer be entitled to under policy 1f. For example, Darryl Weber owns 7 acres and his property is zoned RH-2. RH-2 zoning is more than 4 acres and less than 8, so Darryl has 3 additional acres than necessary in RH-2 and he would be entitled to one additional split because the town requires a 2 acre minimum lot size. The RH zoned properties before December of 1994 would be entitled to splits as long as they would have 2 acres above the minimum number of acres allowed under the zoning classification. The way it reads now, Darryl Weber wouldn’t be allowed an additional split unless he has an additional 4 acres. The splits were capped at 4. Mr. Bremer will look over his notes and report back to the plan commission. The plan commission decided to hold the next plan commission meeting on Monday, February 27, 2012.
7. Discussion and possible action re: 1088 Union Road – violation of deed restrictions.
Steve Schroeder is currently leasing the shop at 1088 Union Road from Richard Lofy. He has been there for about a year and he intends to purchase the property in the future. The plan commission reviewed the zoning classifications. The plan commission recommends that the zoning be changed from C-1 to C-2 that includes an auto mechanic shop. The rezone request can be completed by an agent for Richard Lofy.
8. Discussion and possible action re: Town’s Submittal Application for Land Division, Rezones and CUP.
A copy of rezone applications from other municipalities in Dane County was passed out.
Deputy Clerk Hanson asked for clarification on charging rezone fees for the Anderson rezone next month. The plan commission feels that because the county made a mistake and the fee should be waived.
Motion made by Duffin and seconded by Christensen to adjourn the meeting at 8:25 p.m. Motion carries.
