  1. Open Public Hearing:
    1. Land Division & Rezone Petition # 10204; Parcel #'s 0509-142-8512 & 0509-142-8071. The request is to create one 4.2 acre parcel and re-zone parcel from A-3 and RH-2. Petitioner and Owner is Roger Parsons, 5207 Lincoln Road, Oregon, WI 53575. The petitioner owns a total of 62 acres.
    Chairman Weber called the public hearing open at 6:35 p.m. Mr. Weber made notice that Mr. Parsons was not in attendance.
  2. Close Public Hearing.
    Chairman Weber immediately closed the public hearing and will re-open at a later time.
  3. Call Plan Commission meeting to order.
    Chairman Weber called the plan commission meeting to order at 6:36 p.m. In attendance were Chair Darryl Weber, David Hagemann, Brian Duffin, Sharon Christensen, Town Board Supervisor Chris Johnson and Deputy Clerk, Jennifer Hanson. Andy Blomstrom arrived at 6:43 p.m. There is one position open on the Plan Commission.
  4. Discussion and recommendation to the Town Board:
    Land Division & Rezone Petition # 10204; Parcel #'s 0509-142-8512 & 0509-142-8071.

  5. Approval of minutes from the last meeting.
    Motion Christensen/Hagemann seconded to approve the March 15, 2010 minutes with the following corrections. On page 1, under Item 3 add the sentence "Mr. Jensen, Mr. Welch, Ms. Schmitz and resident Tom Buglass left the meeting to have further discussion in the clerk's office." On page 2, under Item 4 replace the word "park fee" with "impact fee." Motion carries. ** Weber noted the arrival of Roger Parsons and closed the Plan Commission meeting and re-opened the Public Hearing at 6:41 p.m. Mr. Parsons, 5207 Lincoln Rd, appeared to request the creation of a lot on his property on Lincoln Road. The plan commission discussed the location of the 66 foot road frontage requirement. Mr. Duffin asked if the 66 foot of road frontage could run along the existing driveway instead of bisecting the farm land. Mr. Weber doesn't want to see another driveway on Lincoln Road due to safety issues. The plan commission discussed the size of the newly created lot including the length of the driveway and the use of the driveway for farming operation. Weber closed the public hearing and re-opened the regular plan commission at 6:55 p.m. The plan commission discussed their recommendation to the Town Board regarding the Land Division & Rezone submitted by Roger Parsons, Petition # 10204. The plan commission discussed confusion over the density study prepared by Dane County. The density study provided by Dane County reflects the density study on one particular 40 acre parcel and not the "traditional" density study that the plan commission is use to looking at that has the whole farm acreage owned in 1995. Motion Christensen/Hagemann seconded to approve Petition # 10204 with the following conditions: deed restriction on remaining acreage, noted confusion over density study provided by Dane County and moving the 66 foot of road frontage to the current driveway location. Motion carries.**
  6. Public Comments.
    David Cerqua, 5993 County Highway A, appeared to discuss changing the zoning of a building on his property to commercial. His insurance company is asking the building to be rezoned to commercial. It is a pole shed surrounded by 24.5 acres and is currently zoned A-3. The building is used for storage. Duffin said the town could issue a conditional use permit for storage. Mr. Cerqua will check with his insurance company.
  7. Discussion and possible Action re: Dane County passed Ordinance Amendment #45, establishing two zoning districts in the Dane County Zoning Ordinance to facilitate Transfer of Development Rights (TDR) programs.

  8. Discussion and possible Action re: Dane County's Chapter 10 (Zoning) Task Force identified 4 priority zoning code revisions to work on over the next year.

  9. Discussion and possible Approval re: the Village of Oregon amending their ordinance to allow for rounding up of land splits. (Meeting held on April 1st.)
    Duffin attended the Village meeting. The Village of Oregon Plan Commission approved the ordinance amendment requesting the rounding up of land splits. This would pertain to Jerry Jensen's land division request. The Village planner supported the change and the Village Board will vote on the ordinance amendment. Duffin said that the Village of Oregon wants to work with the Town on the Anderson park land.
  10. Discussion and possible Action re: candidates for open position on the Plan Commission.
    The residents that applied for the open position on the plan commission are David Batker, Michael Briggs, Jennifer Erbs, Stephen Root, Warren Schmidt, Wayne Shockley and Tom Wiedenbeck. The plan commission discussed how to handle filling the open position. The plan commission members reviewed the applications silently and then voted on paper ballots to eliminate the bottom three candidates. The plan commission members then discussed what they would like to see in the next plan commission member. The plan commission members did a second vote to narrow it down to the top three candidates. The top three candidates chosen were Tom Wiedenbeck, David Batker and Steve Root. The plan commission had lengthy discussion regarding the questions to ask potential candidates. Weber would like to have a work session to meet with all the candidates on either April 28 or May 12 at 6:30 p.m. A letter should be sent to the other candidates thanking them for their interest and noting that this was a tough decision because they were all qualified candidates.
  11. Discussion and possible action re: updating application paperwork for land split, re-zone or CSM.
    This agenda item was tabled.
  12. Communications.
    A copy of the new building permit application was presented. Blomstrom asked if it is possible to obtain the telephone number of the homeowner so he can contact them to make arrangements for assessing their property.
  13. Adjournment.
    Motion Hagemann/Duffin seconded to adjourn the meeting at 9:09 p.m.
