Town of Oregon Plan Commission Meeting Minutes

Chairperson Darryl Weber Called the Plan Commission Meeting to order at 6:32 p.m. with the following members present Paul Morrison, Andrew Blomstrom, Dave Hagemann, Brian Duffin and Sharon Christensen. Member Lloyd Klahn was absent.

  1. Open Public Hearing to Discuss Conditional Use Permit for construction of an overhead 69kV transmission line; Petition # 01-2008. The request is to construct an overhead 69kV transmission line. Appearing on behalf of American Transmission Company are Sarah Justus, Jason Hogan, Greg Shue and Ben Hock. The need for the project is to connect to the potential substation located at the intersection of Highway CC & D. To describe this route coming from the Fitchburg side, it is located just to the west of Fish Hatchery Road. The challenge was a priority to avoid being just outside of someone's front door. ATC looked at several routes and used many factors in determining location such as environmental impacts, costs and also worked within a framework provided by state law that suggests the use of corridors, such as existing transmission lines and local roads. The result is the cross country route, coming back to Fish Hatchery Road using a property boundary line and follow along down consolidating distribution. This 69kV project is the lowest voltage that makes it a transmission project and not a distribution project. There are no expectations to make changes to the line or increase voltage for the next 10 to 12 years. At the straight line, ATC would use wood poles. They will use larger steel poles to eliminate using guide wires on cultivating fields and also where they make turns. They will write into easement of property owners that they are unable to increase voltage without first obtaining additional easement from property owner.

    Public Comments followed. Sarah Justus clarified that the Alliant legal department determined that this transmission line is a permitted use without the need of a Conditional Use Permit from the Town. They continued to proceed based on the decision to obtain a list of conditions the town may want to impose on the placement of the line.
  2. Close Public Hearing at 7:45 p.m.
  3. Call Plan Commission meeting to order at 7:46 p.m.
  4. Discussion and possible Recommendation to the Town Board:
    1. Conditional Use Permit - construction of an overhead 69kV transmission line; Petition # 01-2008. Motion made by Brian Duffin for recommendation to the Town Board with the following 5 conditions:
      1. Do not erect the 69kV line in the front yards, but as shown on the proposed map dated November 29, 2007.
      2. Do not erect guide wires in the farm fields.
      3. Put the electric service to the two Trosper homes and the Sterling home underground. No poles on the side of the road near the homes.
      4. No other utilities or communication and signal or bigger than a 69kV upon or in the easement that does not run along Highway D.
      5. When crossing farm fields only one pole used in center of field.
      Seconded by Dave Hagemann. Sharon Christensen - yes, Darryl Weber - yes, Paul Morrison - yes and Andy Blomstrom - abstained.
    2. Land Division and Rezone, Pet. 9802 (Alliant construction of an Electrical Substation). Brian Cooke and Greg Aubrey appeared on behalf of Alliant. They have revised the plan to include a 50 ft no structure box, the Village requested a ROW dedication increase of 27 ft. to 60 feet and made the pond larger to have it only 3 feet deep. The experts strongly against lining the basin with rocks because it would affect the natural vegetation, create a need to clear out sediment, water quality and frogs/crickets. Alliant is also paying for a landscaper to provide screening to Dan Piorier and Kari Schlimgen. Motion made by Brian Duffin for recommendation to the Town Board with the following 9 conditions:
      1. Basin moved 100 feet to south.
      2. Basin depth of 3 feet.
      3. 60 feet road right away dedication.
      4. Two rows of trees along east side for screening.
      5. Driveway turn around moved west by 9 feet.
      6. Landscaping and screening provided by Alliant for adjacent landowners.
      7. Moved 13 feet driveway to the west.
      8. Moved 13 feet to the west the incoming power line.
      9. Added 50 feet by 420 feet block on east side of original parcel as a no building zone.
      Include Stipulation: No Residential Housing.
  5. Reading and approval of minutes from the last meeting. Motion made by Dave Hagemann and seconded by Sharon Christensen to approve minutes.
  6. Public Comments. None.
  7. Discussion and possible Recommendation to the Town Board re: letter from Wisconsin Land & Water Conservation Board on Agricultural Preservation Plan. The Plan Commission will attend a meeting to discuss with the County. Jennifer will set-up meeting date, either Tuesday, March 18 or Wednesday, March 19 at 7:00 p.m.
  8. Updates from Dane County. None.
  9. Update/Action on "Comprehensive Plan." Public Hearing at County ZLR scheduled for March 25, 2008.
  10. Communications.
  11. Adjournment. Motion made by Brian Duffin to adjourn Plan Commission meeting and seconded by Dave Hagemann. Plan Commission adjourned at 9:05 p.m.
