Chairperson Darryl Weber called the Plan Commission Public Hearing to order at 6:33 p.m. with the following members present; Paul Morrison, Andy Blomstrom, Lloyd Klahn, Dave Hagemann, Brian Duffin, Sharon Christensen and Deputy Clerk, Jennifer Hanson.
The first hearing was Richard Lofy’s request to change deed restrictions at 1088 Union Road. Pam Raschein from Re Max Realty appeared on behalf of Richard Lofy. She explained that Mr. Lofy would like to broaden deed restrictions because he is selling the property and current deed restrictions limit usage of property. Ms. Raschien said the property would be appropriate for a service type industry, such as a plumber. Mr. Lofy is requesting the same deed restrictions recently placed on the neighboring Vedvik property. Mark Genin, owner of Genin’s Inc., 1090 Union Rd., appeared with concerns about the water drainage and any additions to building. The Plan Commission discussed at length the deed restrictions for the Vedvik property and potential restrictions for Lofy property.
The second hearing was Charles Kiddy’s request for a conditional use permit (CUP) to operate a horse boarding facility at 5594 Alpine Road. The petitioner is Cathy Cline, owner of Phoenix Training Center, who put in an offer to purchase the Kiddy property on the condition of obtaining a CUP to operate a horse boarding facility. Neil Detra, 5590 Alpine Rd. currently shares a driveway with property and is concerned about the increase in traffic and future maintenance of driveway. The petitioner agreed to take responsibility of driveway. Dave Betra, 5556 Alpine Rd., appeared to inquiry if any fencing would be added next to his property. The petitioners have no plans to add fencing near neighboring properties, only to add a gate at driveway entrance. Gary Leveranz, 5666 Alpine Rd., was in attendance to support request for CUP. The Plan Commission discussed driveway issues.
The third hearing was Robert Shillingstad’s request for a land re-zone due to a Dane County Zoning staff error at 6227 Purcell Rd., Petition #9760. Petitioners did not appear. Request to change zoning to A-2 from A-3 to satisfy Dane County zoning requirements based on total acreage.
Chairperson Weber closed the public hearing and opened the regular plan commission meeting.

Approval of Minutes
Klahn would like to change “32 acres” to “35 acres” in last paragraph of minutes from August 28, 2007 minutes. Klahn moves to approve minutes from August 28, 2007. Seconded by Christensen. Motion carries 7-0.
There were no public comments.
Discussion and possible Recommendation re: Moratorium on Subdivision Plat
Weber would like to extend the current Moratorium on Subdivision Plat Submittals for another six months because the Comprehensive Plan is not completed. Weber feels it would be a good gesture because the Village of Oregon recently passed a moratorium on annexations for a year. Motion made by Hagemann to approve and recommend to the Town Board, Ordinance No. 2007-67, An Ordinance Imposing a Moratorium on Subdivision Plat Approvals Within the Town of Oregon, for an additional six months, from October 19, 2007 to April 19, 2008. Seconded by Duffin. Motion carries 7-0.
Discussion and possible Recommendation re: Modifications to Comp Plan & Chap. 10
The Plan Commission tabled items 7 & 8 due to the late receipt of materials needed to discuss the latest modifications to the Comprehensive Plan and Land Division & Subdivision Code, Chapter 10.
Additional Farm Driveway
The Plan Commission discussed an additional driveway request for farm equipment at 457 Union Rd. Plan Commission recommended that the driveway be removed and returned to natural state by November 1, 2007.
The Plan Commission discussed deed restrictions filed for the Vedvik property on Union Rd.
